 BILL NO. 470

 BY-LAW

  a by-law to dedicate Part of 1' reserve west of Lot 13, Registered Plan

825, designated as Part 1, Plan 64R-15943

  WHEREAS it is deemed expedient and in the interest of the Council of the City of Toronto to dedicate certain lands more particularly described as Part of 1' reserve west of Lot 13, Registered Plan 825, designated as Part 1, Plan 64R-15943, as a public highway;

 AND WHEREAS an agreement was entered into between Upper East Side Developments Limited, the City of Toronto and the Bank of Nova Scotia dated the 22nd day of April, 1998 and registered in the Land Registry Office for the Land Titles Division of Toronto (No. 66) on the 28th day of April, 1998 as Instrument No. E163726 (hereinafter called the "Subdivision Agreement").

 The Council of the City of Toronto HEREBY ENACTS as follows:

 1.Part of 1' reserve west of Lot 13, Registered Plan 825, designated as Part 1, Plan 64R-15943 is hereby dedicated as a public highway.

 2.Nothing in this by-law shall be deemed to constitute assumption by the municipality, of a public highway for maintenance purposes. The public highway dedicated as such pursuant to section 1 hereof, shall not be assumed for maintenance purposes until:

 a)expiry of the "Maintenance Period" as set out in a Subdivision Agreement governing construction of the said public highway;

 b)such time as the City Engineers have recommended "Final Acceptance" thereof pursuant to the said Agreement; and

 c)passage of a further by-law by the Council of the City of Toronto assuming the public highway for maintenance purposes.

  3.This by-law shall come into full force and effect on the date of passage hereof.
