BY-LAW No.
Respecting by-laws of the former Municipality of Metropolitan Toronto,
the former Cities of Etobicoke, North York, Scarborough, Toronto and York
and the former Borough of East York governing the sale of real property.
WHEREAS pursuant to clause 2(7)(b) of the City of Toronto Act, 1997 every by-law of an old Council that was in force immediately before the dissolution of the of the former municipality remains in force until the new Council repeals it or amends it to provide otherwise; and
WHEREAS the City Council, pursuant to Clause No. 1 of Corporate Services Committee Report No. 11 adopted, as amended, by City Council at its meeting held on July 29, 30 and 31, 1998, enacted By-law No. 551-1998 to establish procedures governing the sale of real property; and
WHEREAS pursuant to the said Clause No. 1 of Corporate Services Committee Report No. 11, as amended, and By-law No. 477-1998 to confirm the second portion of the proceedings of the Council at its meeting held on the 29th, 30th and 31st days of July, 1998 authority was granted for the by-laws governing the sale of real property of the former Municipality of Metropolitan Toronto, the former Cities of Etobicoke, North York, Scarborough, Toronto, and York and the former Borough of East York to be superseded and replaced by By-law No. 551-1998; and
WHEREAS it is desirable to enact a specific repealing by-law in this matter.
The Council of the City of Toronto HEREBY ENACTS as follows:
1. The following by-laws governing the sale of real property are repealed effective July 31, 1998:
(a) By-law No. 56-95 of the former Municipality of Metropolitan Toronto;
(b) By-law No. 1995-84 of the former City of Etobicoke;
(c) By-law No. 32512 of the former City of North York;
(d) By-law No. 24401 of the former City of Scarborough;
(e) By-law No. 1995-0146 of the former City of Toronto;
(f) By-law No. 3141-95 of the former City of York; and
(g) By-law No. 51-95 of the former Borough of East York.
2. Notwithstanding section 1, if real property was declared surplus pursuant to any by-law of a former municipality referred to in section 1 prior to the enactment of By-law No. 551-1998, the procedures provided for in such by-law of the former municipality shall continued to govern the sale of the said real property.
