To authorize the execution and registration of plans of survey
for the acquisition of all rights, title and interests in premises 299 Yonge Street
(Yonge Dundas Redevelopment Project).
WHEREAS the Council of the former City of Toronto at its meeting held on May 6, 1997 adopted Minute S16.2 authorizing an application for the expropriation of all rights, title and interests in premises 285 to 327 Yonge Street, 1 and 38 Dundas Street East and 259 Victoria Street for municipal purposes; and
WHEREAS Council approved the application and authorized the appropriate City Officials to take the necessary actions to effect the expropriation of all rights, title and interests in premises 285 to 327 Yonge Street, 1 and 38 Dundas Street East and 259 Victoria Street for municipal purposes; and
WHEREAS By-law No. 452-1998, passed on the 10th day of July 1998, expropriated all rights, title and interests in premises 285 to 327 Yonge Street, 1 and 38 Dundas Street East and 259 Victoria Street for municipal purposes; and
WHEREAS the Expropriations Act requires the execution of the plan of survey by the expropriating authority and its registration in the proper land registry office;
The Council of the City of Toronto HEREBY ENACTS as follows:
1. (a) The Chief Financial Officer and Treasurer or her designate and the City Clerk or her designate are authorized to sign Plan of Survey 2124-4 prepared by B. Mulder, Ontario Land Surveyor on the 11th day of September, 1998, and the City Clerk or her designate are authorized and directed to affix the seal of the City of Toronto thereto; and
(b) When signed and sealed, Walter Kowalenko, City Surveyor, is directed to cause Plan of Survey 2124-4 to be registered in the Land Registry Office for the Metropolitan Toronto Registry Division (No. 64), and the Commissioner of Corporate Services is authorized and directed to give notice of the expropriation in accordance with the Expropriations Act.
2. Plan of Survey 2124-4, attached, shall form part of this By-law.
3. This By-law shall be deemed to have come into force on the 14th day of September, 1998.
