BY-LAW No. -1998

To exempt lands municipally known as Nos. 150 to 172 King Street East,

Nos. 61 and 63 Jarvis Street and No. 80 George Street from

the provisions of subsection 50(5) of the Planning Act.

WHEREAS Subsection 50(7) of the Planning Act, R.S.O. 1990, c.P.13, as amended, states that the council of a local municipality may by by-law provide that Subsection 50(5) of the Planning Act, R.S.O. 1990, c.P.13, as amended, does not apply to land that is within a registered plan of subdivision or part or parts thereof;

The Council of the City of Toronto HEREBY ENACTS as follows:

1.Subsection 50(5) of the Planning Act, R.S.O. 1990, c.P.13, as amended, does not apply to a part or parts of land wholly within the lands as described in Schedule "A" to this By-law.

2.Pursuant to the provisions of Section 50(7) of the Planning Act, R.S.O. 1990, c.P.13, and Section 2 of By-law No. 61-95 of the Municipality of Metropolitan Toronto, Section 50(5) of the Planning Act, R.S.O. 1990, c.P.13 ceases to apply to the above-noted lands upon approval of this By-law in accordance with the provisions of the said By-law No. 61-95.

3.This by-law expires on November25,2005.

SCHEDULE "A"

In the City of Toronto and Province of Ontario, being composed of;

FIRSTLY:(Land Titles Office)

Parcel 21-1 in the Register for Section Y-1.

Lots 22, 23, 24 and part of Lot 21 on the north side of King Street, now King Street East, and part of Lot 23 on the south side of Duke Street, now Adelaide Street East, according to the Town of York Plan registered in the Land Registry Office for the Metropolitan Toronto Registry Division (No. 64), designated as PARTS 1 and 2 on Plan 66R-18085 deposited in the Land Registry Office for the Land Titles Division of Metropolitan Toronto (No. 66).

SECONDLY:(Land Registry Office)

Part of Lot 21 on the north side of King Street, now King Street East, on the Town of York Plan designated as PARTS 1 and 2 on Plan 63R-3960, both said Plans being in the Land Registry Office for the Metropolitan Toronto Registry Division (No. 64).

The northerly limit of King Street East and the westerly limit of George Street as confirmed under the Boundaries Act as Plan BA-862 (CT182065).

The hereinbefore SECONDLY described lands being most recently described in Instrument CA234030.

THIRDLY:(Land Registry Office)

Part of Lot 24 on the south side of Duke Street, now Adelaide Street East, on the Town of York Plan designated as PART 1 on Plan 63R-4640, both said Plans being in the Land Registry Office for the Metropolitan Toronto Registry Division (No. 64).

The easterly limit of Jarvis Street as confirmed under the Boundaries Act by Plan BA-862 (CT182065).

The hereinbefore THIRDLY described lands being most recently described in Instrument CA68159.
