Amendments to the Zoning Code

Shell Canada Limited

435 Browns Line

Purpose:

To provide preliminary comments on the processing of an application received on November 16, 1998, from Shell Canada Limited to amend the Commercial Limited (CL) zoning of a site at 435 Browns Line, to permit a service station with a convenience store containing 104 mē (1,120 sq.ft.) of retail space.

Funding Sources, Financial Implications and Impact Statement:

City funding is not required. There are no impacts on capital or operating budgets.

Recommendation:

It is recommended that:

(1)this report be received and that the application continue to be circulated.

(2)when a staff report is available, that a Public Meeting to consider the application be scheduled for a meeting of Community Council.

Reason for Application:

The zoning provisions for service stations permit ancillary convenience stores with up to 20 m2 (215 sq.ft.) of retail space for the sale of a limited range of items such as tobacco products, non-perishable snack foods and soft drinks. As the proposed convenience store would have a larger retail area of 104 m2 (1,120 sq.ft.), sell a wider range of food and convenience goods, and requires relief from certain development standards (e.g. landscaping, garbage enclosure, etc), by-law amendments are required.

Project Information:

The site is located at the northeast corner of Horner Avenue and Browns Line. The existing service station with garage and gas bar would be replaced by a new convenience store/pay point building and expanded gas bar (16 pumps). The convenience store would contain a retail area, as well as washrooms, offices, storage and mechanical facilities. The existing diesel pump island would be replaced.

Gross Site Area:0.322 ha (0.8 ac)

Gross Floor Area: 149 m2 (1,604 sq.ft.)

Other 45 m2 ( 484 sq.ft.)

Issues:

No city-wide issues have been identified. Local issues include: compatibility with adjacent low density residential uses and site plan considerations (e.g. building placement, vehicular access and on-site circulation, landscaping, parking, etc).

Status:

The application is currently in circulation. A staff report on the application will be distributed to Councillors and made available to the public prior to the Public Meeting. A Community Meeting will be held prior to the staff report being tabled if deemed necessary by the ward Councillors. An application for site plan approval is being processed concurrently under delegated authority.
