Amendments to the Zoning Code

Petro Canada

830 Burnhamthorpe Road

File No. Z-2287(Markland - Centennial)

Purpose:

To provide preliminary comments on the processing of an application received on February 19, 1999, from Petro Canada to amend the Commercial Limited (CL) zoning of a site at 830 Burnhamthorpe Road, to permit a service station with a convenience store containing 142 mē (1,529 sq.ft.) of retail space.

Funding Sources, Financial Implications and Impact Statement:

City funding is not required. There are no impacts on capital or operating budgets.

Recommendation:

It is recommended that:

(1)this report be received and that the application continue to be circulated.

(2)when a staff report is available, that a Public Meeting to consider the application be scheduled for a meeting of Community Council.

Reason for Application:

This property is subject to site specific By-law No. 12,299, which only permits the lands to be used for a service station. The zoning provisions for service stations permit ancillary convenience stores with up to 20 m2 (215 sq.ft.) of retail space for the sale of a limited range of items such as tobacco products, non-perishable snack foods and soft drinks. As the proposed convenience store would have a larger retail area of 142 m2 (1,529 sq.ft.), sell a wider range of food, perishable items and convenience goods, and requires relief from the rear yard setback development standard, by-law amendments are required.

Project Information:

The site is located at the southeast corner of Burnhamthorpe Road and Mill Road. The existing service station with garage and gas bar would be replaced by a new convenience store/pay point building and expanded gas bar (16 pumps). The building would contain a retail area, as well as washrooms, offices, storage and mechanical facilities.

Issues:

No city-wide issues have been identified. This site was previously the subject of a Committee of Adjustment application (A-290/98ET) for an identical project. The Committee refused the application and the decision has been appealed to the Ontario Municipal Board by the applicant. Council has authorized legal and staff representation in support of the Committee's decision; however, a Hearing date for the appeal has not been scheduled. The applicant has indicated that they would request the Board to consolidate the Zoning and Site Plan Control applications with any future Hearing.

Local issues include: compatibility with adjacent high density residential uses and site plan considerations (e.g. building placement, vehicular access, circulation, landscaping, parking, etc).

Status:

The application is currently in circulation. A staff report on the application will be distributed to Councillors and made available to the public prior to the Public Meeting. A Community Meeting will be held prior to the staff report being tabled if deemed necessary by the ward Councillors. An application for site plan approval is being processed concurrently under delegated authority.
