Zoning By-law Amendment

1051234 Ontario Limited

7 McIntosh Avenue

Purpose:

To advise Community Council of the status of the application by 1051234 Ontario Limited and their request to have the Zoning By-law amendment placed before Council for adoption.

Funding Sources, Financial Implications and Impact Statement:

City funding is not required. There are no impacts on capital or operating budgets.

Recommendation:

It is recommended that this report be received for information.

Background:

In December, 1997, 1051234 Ontario Limited applied to amend the Zoning Code to permit the use of part of a residentially zoned property municipally known as 7 McIntosh Avenue, for commercial parking in conjunction with a neighbouring restaurant at 624A and 624B The Queensway.

A staff report presented in June, 1998, concluded that from a land use perspective, the use of a portion of the residential lot (7 McIntosh Avenue) for six commercial parking spaces to support the existing commercial uses at 624A and B The Queensway is acceptable. The use could be accommodated with limited impact on adjacent properties and could serve to relieve some of the parking problems currently experienced by the neighbourhood. Staff noted that a parking area created in this manner would be consistent with other Council initiatives for the creation of municipal parking lots located within similar land use contexts.

Staff recommended that a landscape plan and financial guarantee be required prior to Council's consideration of the amending by-law. The applicant was also required to submit a comprehensive plan of all of their land holdings within the immediate area detailing their current and intended use in the context of staff's recommendation and in accordance with the Ontario Municipal Board Decision No. V960436 respecting 620 The Queensway, prior to the approval of the by-law.

A Public Meeting was held on November 12, 1998, at which time Etobicoke Community Council recommended conditional approval of the application. Community Council also requested that the Director of Community Planning, West District, examine the possibility of incorporating one additional parking space, for a total of seven. On November 25, 26, and 27, City Council adopted the recommendations of Community Council.

Comments:

Subsequent to this conditional approval, the applicant has been discussing the comprehensive site and landscaping plan and the additional parking space with Transportation Planning, Works and Emergency Services and Planning staff in order to achieve a workable site plan in accordance with Council's direction. A comprehensive site and landscape plan was prepared, which includes an additional parking space (for a total of 7 vehicle parking spaces) and accompanied by a Financial Guarantee, which fulfills the conditional approval granted by Council.

Conclusions:

As the conditions relating to the enactment of the amendment have been fulfilled, the implementing By-law will be forwarded to City Council for adoption.
