This report provides information for the members of the Etobicoke Community Council with respect to the subject
property.

Council Reference/Background/History:
Councillor Irene Jones has requested that the Director of Building and Deputy Chief Building Official, Etobicoke/York
District, report to Etobicoke Community Council on the status of construction at the subject property and the possibility of
revocation of the permit as a result of the apparent suspension of construction.
Comments and/or Discussion and/or Justification:
Project History:
Building permit C-82989 was issued on July 10, 1997 for the construction of an addition, interior alterations and decks to a
single family dwelling at 51 Glenaden Avenue East, Etobicoke. Construction started September 17, 1997. During the
following fifteen months the owner proceeded to substantially complete the addition and interior alterations. Inspection
staff noted that on December 16, 1998 work had been substantially completed with outstanding work on the exterior
building cladding, exterior grading and interior guards and finishing. In response to a complaint received June 18, 1999
regarding the lack of progress on the exterior cladding, the building inspector attended the property and was advised by the
owner that work on the cladding would be completed during the summer. Recently the owner has forwarded to staff
proposed revisions to the exterior cladding design, which include a combination of stonework and siding.
Permit Revocation:
Section 8, Subsection (10) of the Building Code Act provides the authority to the Chief Building Official to revoke
permits. Pertinent to this issue, the Chief Building Official may revoke a permit issued under the Act:
(i)if, after six months after its issuance, the construction or demolition in respect of which it was issued has not, in the
opinion of the chief building official, been seriously commenced, or
(ii)if the construction or demolition of the building is, in the opinion of the chief building official, substantially
suspended or discontinued for a period of more than one year.
Conclusions:
The renovation work covered under the permit had commenced within the first six months after issuance and has been
completed, for the most part, by the owner during the last two years. The addition and interior work progressed over a
period of fifteen (15) months with the majority of the work being completed by December 16, 1998. With the exception of
the outstanding work, the construction has been completed in accordance with the permit drawings with no outstanding
issues identified by our inspection staff. The progress of construction associated with the subject permit has not been
substantially suspended or discontinued for a period of more than one year. The conditions necessary for a legal revocation
of the permit, therefore, do not exist at this time. Staff will continue to monitor the progress of the work through the regular
inspection process.
