Subject:Safety Concerns at 55 Eldon Avenue

Purpose:

To report to the January 20, 1999 meeting of the East York Community Council in order to provide a status report on the safety concerns at the garage located at 55 Eldon Avenue.

Recommendations:

That this report be provided as information to the East York Community Council.

Background:

The double garage at the rear of 55 Eldon Avenue was damaged by fire on or about November 8, 1998. Initially, the matter of repair was being dealt with by the Building Division but it was subsequently determined that a building permit was not required for the level of repair necesssary and the matter was forwarded to the Municipal Standards Division on December 7, 1998 for action under the Property Standards By-law.

Comments:

The Municipal Standards Division inspected and subsequently issued an Order requiring repair of the garage by December 28, 1998. A reinspection on January 5, 1999 found that although a couple of minor repairs had been attempted, the garage had not been repaired. The inspector met the owner of the property on January 5, 1999 and advised that, if no significant effort is made to repair the garage before month's end, court charges could be laid against them. The owner indicated that they would be making every effort to comply before the end of the month. Considering the enforcement spanned the holiday season and the recent heavy snowfall, it was felt it would be best to allow a little extra time to the owner to accomplish this task. Staff will be monitoring efforts over the next week or two until compliance is met.

Conclusions:

The garage at the rear of 55 Eldon Avenue has been damaged by fire. Municipal Standards has issued an Order requiring appropriate repairs. The owner has indicated that they will do the necessary repairs before the end of the month. Staff will monitor the situation until compliance is met.
