Subject:55 Eldon Avenue

Purpose:

The purpose of this report is to provide an update to Community Council on the Municipal Standards Division's actions at 55 Eldon Avenue.

Recommendations:

That the East York Community Council receive this report for information purposes.

Background/History:

The issue of the condition of a fire damaged garage at 55 Eldon Avenue was raised by Ms. Maureen Lindsay at the East York Community Council meeting on December 9, 1998. Municipal Standards in turn provided a report to the Community Council at its meeting on January 20, 1999. The report indicated that an Order to Comply under the Property Standards By-law had been issued to the owner directing that certain repairs be done. At that time, the Community Council directed staff to initiate legal action and advise the owner of our intent to do so should the required work not be completed by January 31, 1999.

Immediately following the January Community Council meeting, staff contacted the property owner and advised him of the Community Council's motion. On February 1st, an inspector met with the owner on site. As a result of her inspection, she has advised of her findings as follows:

1.Overhead door at laneway has been repaired and owner is ensuring it is left in a closed position to prevent the entrance of unauthorized persons and further damage. There is no lock on the door.

2.Temporary repairs have been made to roof which has withstood sustained snow loads. Further structural repairs will be made upon the return of the owner who has been called to the east coast on urgent family business.

3.Debris outside is still snow covered.

As a result of the inspector's findings, legal action has now been commenced.

Justification:

Property Standards issues in the former Borough of East York are regulated by East York By-law 39-90 as amended.
