Subject:870 Pape Avenue - Transfer of Easement for Vehicular and Pedestrian Access

Purpose:

This report to Council concerns a request by Upper East Side Developments Inc. to execute and register on title a Transfer of Easement for vehicular and pedestrian access in favour of the owner of Part of Lot 122, Plan 66R-18066 over Part of Lot 123, Plan 66R-18066.

Funding Sources:

The cost of preparing and registering these releases will be paid by the owner.

Recommendations:

1.That the City Solicitors for the East York Office be directed to prepare and register on title a Transfer of Easement.

2.That the appropriate City officials be authorized to take such actions and execute such document as may be necessary to give effect to recommendation 1.

History:

The request for the Transfer of Easement is required in order to allow vehicular and pedestrian access in favour of the owner of Part of Lot 122, Plan 66R-18066 over Part of Lot 123, Plan 66R-18006 so that the owner of Part of Lot 122, Plan 66R-18066 may access their property along the laneway and in order to have access to their garage located at the rear of their property. Staff of the East York Office have no objection to the granting of such vehicular and pedestrian access.

Lot 123, Plan 66R-18066 was acquired at the time the Subdivision Agreement was registered in order to provide for the opening of the laneway to Pape Avenue at a later date, if necessary. At this time there is no access to Pape Avenue along this laneway.

Conclusions:

We have circulated the request for the Transfer of Easement to City Planning Staff - East York Office and they have confirmed that there are no concerns with respect to this. It is appropriate to allow vehicular and pedestrian access in favour of the owner of Part of Lot 122, Plan 66R-18066 over Part of Lot 123, Plan 66R-18066.
