Subject:Installation of a Footbridge Over the CP Rail Track and Construction of Sidewalks
Along Millwood Road by IPCF Properties
Purpose:
This report responds to East York Community Council's request that "staff report on IPCF
Properties Inc. intention to install a footbridge over the Canadian Pacific rail tracks adjacent to
Redway Road, and, on the possibility of putting in a sidewalk on the west side of Millwood
Road between the entrance to Leaside Memorial Gardens and the Canadian Pacific Rail
Overpass."
Recommendation:
It is recommended that this report be received for information.
Comments:
IPCF Properties Inc. are the owners of a 5.6 hectare site located at 11 Redway Road. In 1993
they developed the northerly portion of this site with a Loblaws superstore. That development
required approval of a Site Plan application. Planning Staff's review of the 1993 Site Plan file
did not reveal any record of a footbridge being either discussed or required.
Subsequently, in July 1996, IPCF applied to the Borough of East York to rezone the remainder
of the site to permit additional commercial uses. Specifically, the Zoning By-law amendment
which was passed by East York Council on March 12, 1997, permitted the development of the
southerly undeveloped portion of the site with a 3,700 m2 building, allowed for a minor
enlargement of the existing Loblaws superstore, expanded the list of permitted uses, and
imposed various explicit development conditions. The rezoning application was not
accompanied by a concurrent request for Site Plan approval. The processing of the application
involved negotiations between Planning Staff and the developer to refine the proposal, a
community meeting to informally discuss the application with the affected residents as well as
a Public meeting required under the Planning Act. To the best of our knowledge a footbridge
over the CP rail track was never discussed during any of these meetings nor was it a
requirement of the application's approval.
The installation of a sidewalk on the west side of Millwood Road, between the CP Rail Bridge
and Southvale Drive, was identified as a requirement to facilitate pedestrian access to the site.
A clause was included within the Zoning By-law amendment which states that the land cannot
be used, or buildings erected until a sidewalk has been constructed or the monies have been
provided by the developer for its construction.
Given that IPCF is committed to constructing the sidewalk, we do not recommend that it be
constructed with public funds at this time.
