Subject:REQUEST FOR DIRECTION ON

MINOR VARIANCE APPEALS

Purpose:

The purpose of this report is to seek direction from Council regarding appeals of the Committee of Adjustment decisions described below. This report is for the consideration of the East York Community Council at their meeting of June 23, 1999.

Recommendation:

It is recommended that this report be received for information.

Comments:

Variance Application A40/99EY

Mr. Peter Colarossi

Re: 150 Glenvale Boulevard

The applicant is proposing to construct a second storey addition and a two-storey rear addition to the dwelling at 150 Glenvale Boulevard. He applied to the Committee of Adjustment for variances from the maximum floor space index and building length requirements, and the minimum side yard setback requirement. On April 13, 1999, the Committee approved variances to the building length and side yard requirements, but refused the floor space index variance. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

2.Consent Applications B7/99EY and B8/99EY

Variance Applications A41/99EY, A42/99EY and A43/99EY

Ms. Maria Missailidis

Re:7 and 9 King Edward Avenue

The applicant requested the consent of the Committee of Adjustment to sever the land at 7 and 9 King Edward Avenue into three lots for detached dwellings. The applicant also requested a variance to the minimum lot frontage requirement for each proposed lot, and variances to the side yard setback requirements for both side yards on each proposed lot. On April 13, 1999, the Committee of Adjustment refused all of the consent and variance applications. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

3.Variance Application A44/99EY

Mr. Peter Zotalis

Re: 35 Beechwood Drive

The applicant requested a variance to permit a carport in front of the house at 35 Beechwood Drive. He applied to the Committee of Adjustment for relief from the side yard setback requirement and from the restriction against accessory structures in the front yard. The Committee of Adjustment refused the application on May 11, 1999. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

4.Variance Application A55/99EY

Mr. David Black (Timothy's Coffees of the World Inc.)

Re: 1515 Bayview Avenue

The applicants requested a variance to the restaurant parking standard in order to permit a coffee shop on the ground floor of the building at the northeast corner of Bayview Avenue and Millwood Road. On May 11, 1999, the Committee of Adjustment approved the application. The decision was appealed by several residents of Donegal Drive.

The Transportation Services Division provided the Committee of Adjustment with comments on the application, and indicated they have no objection to the proposal. Staff did not provide the Committee with a recommendation on the disposal of the application, however, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.
