Subject:16 - 30 Byng Avenue

Ontario Municipal Board Hearing held on March 25, 1999

Purpose:

The purpose of this report is to advise of the outcome of the Ontario Municipal Board Hearing held with respect to 16 - 30 Byng Avenue on March 25, 1999.

Recommendation:

That this report be received for information.

Council Reference/Background/History:

The owner of 19 Holmes Avenue appealed the re-zoning of 16-30 Byng Avenue to permit a 136 unit, 14 storey residential building on the site. The principal basis of the appeal was that the development would leave the lands at 19 Holmes Avenue undevelopable.

Legal and Planning staff attended the Ontario Municipal hearing held on March 25, 1999 in support of the zoning by-law.

By its Oral Decision and Order issued March 30, 1999, the Ontario Municipal Board dismissed the appeal. A copy of the Board's Decision and Order is attached for Council's information.

Conclusion:

That this report be received for information.
