OFFICIAL PLAN AMENDMENT APPLICATION

Glenarda Properties Ltd.

20 Bond Avenue

Lot 5, Plan M-525

UDOP-99-21

WARD 11 - DON PARKWAY

Purpose:

This report advises that the owners of the property at 20 Bond Avenue have made an application to amend the official plan to redesignate the lands from Industrial (See Schedule "A") to a residential designation in order to permit 75 residential units, consisting of 11 detached and 64 semi-detached units (See Schedule "C").

On April 28, 1999, North York Community Council recommended that the zoning amendment (UDOZ-98-13) and draft plan of subdivision applications (UDSB-1238) for this site be refused, and that the lands retain their current industrial designation and zoning of Industrial Zone One (M1) (See Schedule "B").

The applicant has referred the zoning and draft plan of subdivision applications to the Ontario Municipal Board. A pre-hearing conference was held on May 17, 1999, with a second scheduled on August 9, 1999. The hearing has been scheduled for nine days beginning on October 12, 1999. The official plan amendment was appealed to the OMB and consolidated with the other matters before it on August 9, 1999.

Recommendation:

It is recommended that:

(1)this report be received for information.

  Background:

On April 28, 1999, a Principles of Development Report for the Zoning Amendment Application UDOZ-98-13 and Draft Plan of Subdivision Application UDSB-1238 for the lands at 20 Bond Avenue was considered by Community Council.

At the meeting, Community Council recommended to Council that:

(1)the report (April 14, 1999) from the Acting Director, Community Planning, North District, not be adopted;

(2)the Zoning Amendment and Draft Plan of Subdivision application, submitted by Glenarda Properties Limited be refused and the lands retain their current industrial designation and zoning of Industrial Zone One (M1); and,

(3)to prepare for the OMB hearing, that the City Solicitor be directed to report on the North York Community Council on the retention of consultants as may be necessary to defend the City's position.

These recommendations were adopted by Council at its meeting held on May 11 and 12, 1999.

Comments:

The official plan amendment application for this site has been circulated to various departments and agencies for comment. Once received, these comments will be forwarded to the OMB for its information.

Given that the zoning amendment and draft plan of subdivision applications were refused by Council, and that the applications have been referred to the OMB, Staff will not report further on the official plan amendment application unless directed to do so by Council.
