OFFICIAL PLAN AND ZONING BY-LAW AMENDMENT APPLICATIONS

Purpose:

This report responds to the request by North York Community Council for a report on the stability of the top of bank for this property. The site is the subject of official plan and zoning amendment applications for the development of 24 condominium townhouse units on a private road at 1723 Finch Avenue West.

Recommendation:

It is recommended that:

(1)this report be received for information.

Background:

A preliminary evaluation report for this site was received by North York Community Council at its meeting on June 23, 1999 and adopted by City Council at its meeting held on July 6, 7 and 8, 1999 (See Appendix "A").

In addition to discussing the proposal, official plan and zoning for the site, the report identified a number of planning considerations for this application, including the impact on valley lands. The site is located partially within the valley corridor of the Humber River, adjacent to the Black Creek, and is subject to the policies and regulations of the Toronto and Region Conservation Authority (TRCA).

At the time of the writing of the preliminary report, the TRCA required confirmation of the staked top of bank on the site and completion of a geotechnical report to determine the long term stable slope line (top of bank) prior to providing comments on the development proposal. Any lands below the stable top of bank are to be set aside for public acquisition in accordance with the policy of TRCA and zoned appropriately to prohibit structural encroachment.

In considering the preliminary report, the North York Community Council requested the Director, Community Planning, North District, to bring forward, prior to the final report, a separate specific report on the top of bank, to be considered at a future North York Community Council meeting (See Appendix "B"). This report provides information on the top of bank for the site and the comments received from the TRCA.

Comments:

The TRCA has received confirmation of the staked top of bank on the site and a completed geotechnical report. Based on this information, comments have been received from the TRCA (Schedules "C" and "D") which do not object to the approval of the official plan and zoning by-law amendments provided that they include the following:

(a)the lands below the stable top of bank must be appropriately zoned and designated to prohibit structural encroachment, or the removal of vegetation except for resource management purposes; and

(b)a minimum setback of 10 metres from the stable slope line for all building, structures and other appurtenances from the stable top of bank limit.

(c)a permit under Ontario Regulation 158 is required from TRCA for grading within the eastern and southern portions of this property. The applicant must obtain approval prior to the issuance of the building permits by the municipality. Grading beyond the top of bank will not be permitted.

The plans reviewed by TRCA originally included decks at the rear of the units which extended into the 10 metre setback from the top of bank. Revised plans have been submitted by the applicant which illustrate that there is no longer any encroachment into the required setback (Schedules "E" and "F"). These revised plans will be reviewed by TRCA and their comments on these plans will be discussed in the final report.

Conclusions:

The comments from TRCA, which do not object to the approval of this application, subject to the above noted conditions, will be included in the final report to be forwarded to Community Council. The official plan and zoning by-law amendments for the site will reflect the conditions of approval from TRCA and the revised site plan will be reviewed by TRCA to ensure that there is no encroachment into the 10 metre setback.
