Dear Ms. Wong:

At its meeting on Wednesday, September 22, 1999, the Commission considered the attached report entitled, "Procurement Authorization Traffic Barriers For Spadina LRT."

The Commission adopted the Recommendation contained in the above report, as listed below:

"It is recommended that the Commission:

1)Approve a previously unscheduled and unbudgeted expenditure of $1,500,000 for the provision of permanent traffic barriers along the Spadina LRT Streetcar line from College Street to Front Street;

2)authorize the issuance of Purchase Orders to the City of Toronto in an aggregate amount not to exceed $1,400,000, without further authorization, for the design, contract procurement, construction, supervision and project management of the project;

3)authorize staff to proceed with project expenditures immediately as required to comply with City Council directives adopted at its meeting of July 27, 28, 29 and 30, 1999;

4)forward this report to the City Policy and Finance Committee for their information."

SUBJECT:PROCUREMENT AUTHORIZATION

TRAFFIC BARRIERS FOR SPADINA LRT

RECOMMENDATIONS

It is recommended that the Commission:

1)Approve a previously unscheduled and unbudgeted expenditure of $1,500,000 for the provision of permanent traffic barriers along the Spadina LRT Streetcar line from College Street to Front Street;

2)authorize the issuance of Purchase Orders to the City of Toronto in an aggregate amount not to exceed $1,400,000, without further authorization, for the design, contract procurement, construction, supervision and project management of the project;

3)authorize staff to proceed with project expenditures immediately as required to comply with City Council directives adopted at its meeting of July 27, 28, 29 and 30, 1999; and

4)forward this report to the City Policy and Finance Committee for their information.

FUNDING

As indicated in the attached memo of July 26, 1999 from the Interim Chief General Manager to the Commission, the proposed project is unbudgeted in the TTC's approved 1999-2003 Capital Program. As a result of Council's direction, a new budget item has been included in the proposed 2000-2004 Capital Program for this project. To comply with City Council's July1999 directive that design work proceed immediately and that funding be provided by TTC, staff previously prepared a Purchase Authorization to the City in the amount of $50,000.00 to provide immediate interim funding pending consideration of this report by the Commission.

BACKGROUND

Since being placed in service in July 1997 the Spadina LRT Streetcar line has experienced an unacceptably high level of car/streetcar accidents at unsignalized intersections.

In July 1998, City Council approved the installation of temporary bollards adjacent to the streetcar right-of-way until such time as an appropriate permanent barrier design could be developed and implemented in consultation with the community.

At its meeting of July 27, 28, 29 and 30, 1999, City Council adopted the following recommendations contained in Clause No. 1 of Report No.3 of the Policy and Finance Committee:

"It is recommended that:

(1) the following recommendation of the Planning and Transportation Committee embodied in the communication dated July 20, 1999 from the City Clerk, be adopted:

'That the funding for the installation of permanent barriers on Spadina Avenue to be erected upon the removal of the temporary barriers by December 1, 1999, be provided by the Toronto Transit Commission'; and

(2)in order to begin design and contract preparation for the Spadina Barrier immediately, staff be authorized to retain urban design and engineering design consultants directly, without going through a Request for Proposals procurement process, at a cost not to exceed $150,000.00."

DISCUSSION

In response to the above City Council directives, staff from the City's Planning and Urban Development Services and Transportation and Technical Services divisions have already assumed responsibility for managing the design, contract procurement and construction supervision of the project and have retained the services of urban and engineering design consultants to commence preliminary design and prepare materials for the planned public consultation process all in accordance with the following preliminary workplan and schedule prepared by City staff:

CAugust - September 1999-Retain consultants; refine conceptual designs; develop information for public meetings

CSeptember - October 1999-Hold two public meetings

CNovember 15, 1999-Detailed design and contract documents complete

CNovember 15 - December 15, 1999-Tender and award contract

CApril 2000-Start construction

The overall cost of the project has been estimated by City and TTC Staff to be in the order of $1,500,000 which is to be provided by TTC according to Council's decision. Of this amount, $1,400,000 will be allocated for City of Toronto costs and $100,000 for TTC costs.

TTC Engineering and Service Planning Staff are part of the project team and TTC is to have the opportunity to review and approve all designs and proposed construction contracts produced by the City and/or their consultants in so far as they may impact TTC Operations. TTC staff will also participate in the public consultation process as required. All City invoices for their own staff time or consultant services will be submitted for review and approval by TTC staff.

JUSTIFICATION

The project must proceed as described in order to comply with City Council directives.
