Recommendations:

Council Reference/Background/History:
Council, at its meeting of October1and2,1998, authorized that the City Solicitor attend at the Ontario Municipal Board in
support of the Committee of Adjustment refusal to grant a variance respecting a rear yard setback.
Comments and/or Discussion and/or Justification:
The City Solicitor and Commissioner of Urban Planning and Development Services attended at the Ontario Municipal
Board on December 9, 1998. The appellant, in addition to the variance appeal, also appealed his accompanying lot
severance (consent) refusal. The City's planning evidence supported a settlement wherein 3 equal sized (approximately)
lots, with a road widening of Meadowvale Road (5.17 metres), were created. The decision and order of the Ontario
Municipal Board granting the variance and the consent to sever issued January 7, 1999 and the amended decision and order
issued February10,1999 are attached to this report.
Conclusions:
I am recommending that this report be received for information.
