Purpose:
To report to the Scarborough Community Council on an application for a fence by-law
exemption deferred from its meeting on December 9, 1998.
Financial Implications and Impact Statement:
Nil.
Recommendations:
That owing to a lack of resolution as to the location of the fence, Scarborough Community
Council not approve the request from the owners of 34 Allangrove Crescent.
Background/History:
At its meeting on December 9, 1998, the Scarborough Community Council deferred a report
concerning a request for a fence exemption by Bruce Cossar and Laurie Vogan. The deferral
took place because a survey was produced showing the fence to be partially on the Wong's
property which is directly behind the applicant's property. It was the Legal Services advice at
the time that the Community Council could not consider the application until the fence
encroachment was resolved.
As a result of this deferral, a letter was sent to the applicants and Mr. Wong on December 14,
1998, outlining the Community Council's reasons for deferral and requesting a timely
resolution or else enforcement would proceed. Since then, attempts to contact the parties have
been unsuccessful and re-inspection on February 1, 1999 revealed no change at the site. While
weather conditions may preclude any work on the fence, staff believe that more than adequate
time has been allowed for the applicants and their neighbour to resolve the issue of the fence
location.
