Purpose:

The applicant is seeking approval to erect a fence along her property's rear lot line to a height of 2.3metres (7.5 feet).

Financial Implications and Impact Statement:

Nil.

Recommendations:

It is recommended that City Council approve the application to permit the construction of a board on board fence at a height of 2.3 metres (7.5 feet) along the rear property line.

Background/History:

In early February 1999, the District received a request from the owner of 62 Cornell Avenue to construct a fence at a height of 2.3 metres (7.5 feet) along the rear lot line. The applicant indicated that two new houses had been constructed to the rear of her property and owing to the height of the new houses, a certain degree of privacy has been lost. In addition, a problem has arisen respecting a porch light which is shining into the applicant's living room.

By-law 24945 as amended provides for a maximum fence height of 2 metres (6 feet 8 inches) and the variance request of .254 metres (10 inches) is considered minor.

Justification:

Section 14 of By-law 24945, as amended, provides that any person may apply for an exemption to any provision of the By-law.
