CONSENT APPEAL

Purpose:

This report seeks direction from Council regarding the City Solicitor's role at a pending Ontario Municipal Board hearing on a current appeal, as further detailed below.

Recommendation:

It is recommended that:

Council direct the City Solicitor to attend the Ontario Municipal Board, in support of the decision of the Director of Community Planning, East District with respect to Consent application #SB31/98.

The owners of the subject site submitted a Consent application to divide the property into two separate parcels, each having a minimum frontage of approximately 11.4 metres (37.4 feet).

The current Zoning By-law permits one single-family dwelling per parcel having a minimum lot frontage of 12 metres (40 feet) on a public street. In this regard, Minor Variance applications (SA64/98 and SA146/98) were approved by the Committee of Adjustment on December 2, 1998, permitting each lot to have a minimum lot frontage of 11.4 metres (37.4 feet) on a public street. The variance approval is final and binding.

The Consent was approved by the Director of Community Planning, East District, on January 4, 1999. The Consent decision was appealed to the Ontario Municipal Board by the owners of 214 Randall Crescent and 49 MacDuff Crescent. A hearing on this matter has been scheduled for April 27, 1999.

The proposed severance complies with the Cliffcrest Community Secondary Plan which designates the lands as Low Density Residential, and the proposed lot frontage complies with the minimum requirement of the Zoning By-law, as varied by the Committee of Adjustment. The proposed lots would be compatible with lot sizes within the immediate neighbourhood.

Conclusion:

The City Solicitor should be directed to attend the Ontario Municipal Board Hearing in support of the decision of the Director of Community Planning, East District, regarding this consent.
