Subject:Food and Beverages in Recreational Uses

Purpose:

At its meeting on June 22, 1999, the Scarborough Community Council requested that "The Director and Deputy Chief Building Official, East District, and the Manager, Municipal Standards, East District, report on the result of their investigations respecting the Midland Avenue and Weybright Court locations."

Report:

The property known municipally as 3880 Midland Avenue came to the attention of the Municipal Standards Division in October 1998 when a complaint was lodged concerning excessive noise at the property. Subsequent to the complaint, the division became aware of thirty one special occasion permits which had been issued over the past year.

Examination of the property revealed a social club located on the second floor of the building. A review of Zoning By-law 24982, as amended, indicated that the property was zoned Community Commercial (CC), Employment (E) and Recreational (RU). The Zoning Section of the Building Division advised that while the social club for recreational uses was permitted, the use of the club as a banquet hall was not.

Acting upon this information, Municipal Licensing and Standards requested the Alcohol and Gaming Commission to flag the property and cease issuing special occasion permits. This was, in fact, done and no further complaints respecting noise have been received.

The division checked its records concerning complaints received about parties at 2360 Midland Avenue. No record of complaint was noted. Notwithstanding, the Alcohol and Gaming Commission has been requested to flag this address in order to prevent the issuance of special occasion permits.
