Subject:Preliminary Report on 64 Colgate Avenue - Application No. 298008 for an Official Plan Amendment, Rezoning and Site Plan Approval to permit a 6 storey building with live/work units (Ward 25 - Don River).

Purpose:

To permit the construction of a 6 storey building containing 230 live/work units and a two level underground garage at 64 Colgate Avenue.

Source of Funds:

Not applicable.

Recommendations:

It is recommended that:

1.I be requested to hold a public meeting in the community on January 5, 1999 to discuss the application and to notify owners and tenants within 300 metres of the site and the Ward Councillors.

2.The owner be advised that, prior to final Council approval of this project, the owner may be required to submit a Noise Impact Statement in accordance with City Council's requirements. The owner will be further advised of these requirements, as they relate to this project, by the Commissioner of Works and Emergency Services.

Background:

Site:

The site is located on the north side of Colgate Avenue west of Carlaw Avenue.

Proposal:

This application is for permission to construct a 6 storey live/work building containing 230 units and 2 levels of underground parking with 221 parking spaces. Parking for 9 additional cars is provided outside, north of the building. The proposed gross floor area of the building is 17,103 mē.

Applicable Planning Controls:

The Official Plan designation for this site is Mixed Industrial-Residential Area. The Mixed Industrial-Residential Area designation permits existing industrial uses to continue while additionally permitting, through rezoning, the introduction of residential uses such as live/work units. Maximum residential densities permitted through rezoning would be two times the area of the lot. The zoning is I2 D3 which permits industrial uses up to three times the lot area. The height limit is 18.0 metres.

Comments:

Official Plan Amendment No. 122, adopted by By-law No. 238-1998, came into force on July 21, 1998. The Official Plan now permits consideration of residential uses at this location through a rezoning. The proposal would require an Official Plan Amendment as the gross floor area of the project exceeds 2 times the lot area by 5903 mē.

The zoning of the site is I2 D3 requiring a zoning by-law amendment to permit live/work units at this location. The proposal exceeds the height limit of 18 metres by 4 metres. The plans will be reviewed in accordance with the usual circulation process, including holding a public meeting in the area. In addition, Site Plan Approval will be part of this application review.

A Plan of Subdivision application is being processed for these lands and a public meeting is scheduled to be held in the area on January 5, 1999, at the Ralph Thornton Community Centre to discuss this application with the community. The project involves the construction of 106 semi-detached houses and townhouses with this 6 storey live/work building. A public park of approximately 1300 mē is proposed for the Colgate Avenue frontage, located directly west of 64 Colgate Avenue, and will be secured as part of the Plan of Subdivision application.

The following issues will require review and resolution prior to final reporting:

1.The Official Plan amendment required for this application will be the first request following the introduction of the new by-law. The density exceeds that anticipated by 1.05 times.

2.The inside corner units should be combined or redesigned to ensure natural light into these units.

3.The grade elevation changes along the front elevation of the site. Therefore, a height variance will be considered with this application.

Conclusions:

This application should be discussed with the community.
