Subject:Installation of a Snow Melting System - 61 Hillholm Road (Midtown)
Purpose:
To report on the homeowner's request to install a snow melting system underneath a driveway within the City's right of
way fronting 61 Hillholm Road. As this type of installation does not fall within the standard provisions of Municipal Code
Chapter 313, Streets and Sidewalks, of the former City of Toronto Municipal Code, I am required to report to your
Committee.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendation:
That City Council approve the installation of a snow melting system within the City's right of way fronting 61 Hillholm
Road, subject to the owner entering into an agreement with the City of Toronto, as prescribed under Chapter 313 of the
former City of Toronto Municipal Code, and agreeing to:
(a)indemnify the City from and against all actions, suits, claims or demands and from all loss, costs, damages and expenses
that may result from such permission granted;
(b)maintain the snow melting system in good and proper repair and a condition satisfactory to the Commissioner of Works
and Emergency Services;
(c)accept such additional conditions as the City Solicitor or the Commissioner of Works and Emergency Services may
deem necessary in the interest of the City; and
(d)remove the snow melting system upon receiving 90 days notice from the City so to do.
Comments:
Ms Yana Lukatsky of G.E.S. Construction Limited, acting on behalf of the owners, James Cole and Jamie Mason, 2
College View Avenue, Toronto, Ontario M5P 1J3, submitted an application dated November 18, 1998, requesting
permission to install a snow melting system within the City's right of way fronting 61 Hillholm Road. The snow melting
system will be situated immediately back from the rear edge of the City sidewalk.
In a letter dated November 11, 1998 (Appendix 'A'), the owners requested permission to install a snow melting system
within the City's right of way.
Staff reviewed the application and confirm that the snow melting system will not impact negatively on the public right of
way.
Details of the snow melting system are shown on the attached drawing (Appendix 'B').
Conclusions:
As this snow melting system will not impact negatively on the public right-of-way, it should be permitted, subject to the
owners entering into an agreement with the City of Toronto.
