To provide information on the legality of search lights on the CN Tower.

Council Reference/Background/History:
Contained within Clause No. 1 of Report No. 15 of the Toronto Community Council, which was before Council at its
meeting of December16and17,1998, respecting sign variances for 40 Bay Street (Air Canada Centre), was a request of the
Toronto Community Council that the City Solicitor, in consultation with the Commissioner of Urban Planning and
Development Services, report on the legality of mobile and stationary search lights on the CN Tower.
Comments and/or Discussion and/or Justification:
I have received a memorandum from VirginiaM.West, Commissioner of Urban Planning and Development Services, dated
February11,1999 which is attached for information. Search lights on the CN Tower property appear to be a sign as defined
in the Sign provisions of the Municipal Code of the former City of Toronto but are not a permitted use. Hence a variance
from the Sign provisions of the Code would be required to permit such use.
