Subject:48 Glen Road,- Removal of One City Owned Tree, and One Private Tree, and Injury To One Private Tree - Ward 23 Midtown

Purpose:

An application for a permit to remove two trees, one on City property and one on private property, and to injure another tree on private property, to allow for the construction of a below grade garage has been filed by Mr. Tom Spragge, Spragge & Company Architect, 10 Britain Street, Toronto, M5A 1R6, agent for the owner's of 48 Glen Road, Capel and Diana Emery, 48 Glen Road, Toronto, M4W 2V1.

Recommendations:

It is recommended that:

1.Toronto Community Council approve the request for the removal of one City owned tree, and one private tree, and injury to one private tree and such approval be conditional on:

a)the trees in question not being removed or injured until permitted construction and/or demolition related activities in accordance with plans approved under the building permit application for the subject project commence which warrant the destruction of the trees; and

b)the implementation of the recommendations in the tree preservation report, for the privately owned sugar maple, prepared by Arborvalley Urban Forestry Co. Inc., dated March 15, 1999; and

c)the applicant submitting a certified cheque in the amount of $1245.43 to cover the value of the City owned tree, it's removal and replacement costs, and the applicant agreeing to the planting of a replacement tree to be planted on City property upon completion of construction; and

d)the applicant agreeing to plant a large growing shade tree, to replace the privately owned black locust, to the satisfaction of the Commissioner of Economic Development, Culture and Tourism.

Comments:

The trees in question include a twenty-three centimetre diameter City owned Schwedler Norway maple, in good condition, a forty centimetre diameter black locust, on the private property of 46 Glen Road, in fair condition, and a 73 centimetre diameter sugar maple on the private property of 48 Glen Road, in fair condition. The proposed driveway and underground garage will require the removal of the City owned Norway maple and the privately owned black locust. The construction of the driveway will impact the root system of the sugar maple. If approval is given for the removal of the black locust, the applicant will make arrangements with the owner of 46 Glen Road for tree removal and for the planting of a replacement tree to the satisfaction of the owner of 46 Glen Road and our Department. If the City owned tree is approved for removal, the applicant will be required to pay all costs associated with tree removal and to pay for the planting of a replacement tree after construction is completed. The privately owned sugar maple can be protected from injury provided the tree preservation recommendations put forth in the report prepared by Arborvalley Urban Forestry Co. Inc., are implemented and adhered to.

A notice of application sign was posted on the property for the required 14 day posting period, in order to notify the neighbourhood and provide an opportunity for objection to the application for removal and injury of the private trees. One written objection was received in response to the application to remove and injure the trees in question. A copy of this letter has been forwarded to the Community Council Secretary for the Community Council to review.
