Subject: Draft Sign By-law - Automobile Service Stations and Gas Bars (High Park, Trinity-Niagara, Davenport, North Toronto, Midtown, Downtown, Don River and East Toronto)

Purpose:

Attached is a draft by-law amending the sign provisions of the Municipal Code of the former City of Toronto, respecting automobile service stations and gas bars as recommended by the report of the Acting Commissioner of Urban Planning and Development Services (September 27, 1999).

Funding Sources, Financial Implications and Impact Statement:

The enactment of the Draft By-law has no financial implications for the City. It requires no funding.

Recommendations:

It is recommended that:

(1) the Toronto Community Council hold a public meeting in respect of the Draft By-law in accordance with the provisions of the Municipal Act.

Following the public meeting and in the event the Toronto Community Council wishes to approve the Draft By-law, it could recommend that:

(2) the Draft By-law attached to the report (September 30, 1999) of the City Solicitor be approved and that authority be granted to introduce the necessary bill in Council to give effect thereto;

(3) the recommendations of the report of the Acting Commissioner of Urban Planning and Development Services (September 27, 1999) be adopted.

Council Reference/Background/History:

Toronto Community Council will have before it the final report of the Acting Commissioner of Urban Planning and Development Services (September 27, 1999) at its meeting to be held on October 12, 1999 concerning the above noted subject. This report recommends amendments to the sign provisions of the Municipal Code of the former City of Toronto respecting automobile service stations and gas bars. The draft by-law implementing such amendments is attached.

Comments and/or Discussion and/or Justification:

This report contains the necessary Draft By-law, which, if enacted, will give effect to the planning report.

BY-LAW No. -1999

To amend the former City of Toronto Municipal Code Ch. 297, Signs,

respecting gas stations.

The Council of the City of Toronto HEREBY ENACTS as follows:

1. Section 297-2 of Chapter 297, Signs, of the Municipal Code of the former City of Toronto is amended by inserting after the definition of "FUEL PUMP SIGN", the following:

GAS STATION MERCHANDISE SIGN - A non-illuminated sign of not more than one and five-tenths (1.5) square metres in area per side, erected on a permanent foundation and designed for the display of changeable copy for the promotion only of goods or services sold or provided on the property.

2. Section 297-10 is amended as follows:

A. By adding to the table in Subsection C(2) beneath the listed headings the following:
