STAFF REPORT

Subject: Naomi's Kitchen - Operation of the Boulevard Cafe During the 1999 Cafe Season - Bellwoods Avenue Flank of 913 Dundas Street West

(Trinity-Niagara)

Purpose:

To report on the operation of the boulevard cafe on the Bellwoods Avenue flank of 913 Dundas Street West during the 1999 cafe season, as requested by City Council.

Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendation:

It is recommended that this report be received for information.

Background:

City Council, at its meeting of December 16 and 17, 1998, approved the application for a boulevard cafe on the Bellwoods Avenue flank of 913 Dundas Street West, notwithstanding the negative result of the public poll, subject to the applicant complying with the criteria set out in § 313-36 of Municipal Code Chapter 313, Streets and Sidewalks, of the former City of Toronto Municipal Code, and required the cafe to close and clear by 10:00 p.m., 7 days a week. In addition, City Council requested the Commissioner of Works and Emergency Services to report back at the end of the 1999 cafe season on the operation of the cafe.

Comments:

A licence for the boulevard cafe on the Bellwoods Avenue flank of 913 Dundas Street West was issued to Mr. Oswaldo Luiz, Naomi's Kitchen on February 8, 1999. On routine inspection we were informed that Mr. Luiz had sold the business and the new business operator was not interested in obtaining cafe privileges. We have closed our file.

Conclusions:

As the current business operator is not interested in seeking boulevard cafe privileges and the file has been closed, this report is submitted for information only, as no further action is required by the Toronto Community Council.
