Subject: Designation of 832 Bay Street

McLaughlin Motor Car Showroom

Downtown

Purpose:

To designate the property at 832 Bay Street (McLaughlin Motor Car Showroom) for architectural and historical reasons under Part IV of the Ontario Heritage Act.

Recommendations:

It is recommended that:

(1) authority be granted for the introduction of the necessary Bill in Council to designate 832 Bay Sreet (McLaughlin Motor Car Showroom) (Downtown) for architectural and historical reasons under Part IV of the Ontario Heritage Act; or

(2) if a notice of objection to the designation is received by the Clerk by December 12, 1999, Council refer the matter to the Conservation Review Board for a hearing and report pursuant to Section 29 of the Ontario Heritage Act; and

(3) the appropriate City Officials be directed to take whatever action may be necessary to comply with the provisions of the said Act in respect of such designation or Conservation Review Board hearing.

Financial Implications & Impact Statement

There are no financial implications resulting from the adoption of this report.

Background:

Pursuant to action of City Council at its meeting held on September 28 and 29, 1999 (Toronto Community Council Report 12 Clause 51), Notice of Intention to Designate 832 Bay Street (McLaughlin Car Showroom) (Downtown) as a property of architectural value or interest was sent to the owner and the Ontario Heritage Foundation and, also in accordance with Section 29 of the Ontario Heritage Act, notice of such intention was published in a newspaper on November 12, 1999. Under the Act, a person who objects to a proposed designation has thirty days from the date of publication of the notice of intention to designate, to serve on the Clerk a notice of objection.

Comments:

832 Bay Street is subject to an Agreement of Purchase and Sale which is conditional upon designation of the property being finalized prior to the sale. The solicitor for the purchasers has advised that the transaction is scheduled to close prior to December 31, 1999 and has requested that Council designate 832 Bay Street as soon as possible. Council will be advised by Supplementary Report on December 14,1999 whether any objections to the designation were received by the Clerk.

Conclusions:

Both the Notice of Intention and the newspaper insertion stated that any objection be served on the City Clerk, c/o Frances Pritchard, Administrator, Toronto Community Council within thirty days, expiring December 12, 1999. If no objections are received, 832 Bay Street will be designated under the Ontario Heritage Act. If an objection is received the Conservation Review Board will hold a hearing with respect to the matter.
