Subject:OMG Media Agreement
Purpose:
To respond to Council's request regarding the agreement between OMG Media Inc. and the former City of Etobicoke.

Council Reference/Background/History:
At its meeting of May 11, 12 and 13, 1999, Council directed the Commissioner of Works and Emergency Services to
submit a report to the Works and Utilities Committee on whether OMG Media Inc. has fully complied with its agreement
with the former City of Etobicoke.
Comments and Discussion:
In 1997, the former City of Etobicoke entered into an agreement with OMG Media Inc. for the supply, installation and
maintenance of litter containers and Info-Bars with advertising components (Info-Bars are structures designed to assist in
directing pedestrian traffic).
The following is a summary of the key elements of the agreement between OMG Media and the former City of Etobicoke
(copies of the full agreement are available upon request from this Department).
1.The term of the agreement is ten years commencing June 1, 1997.
2.OMG Media is responsible for supplying, installing, maintaining and repairing the litter bins and Info-Bars.
3.The location of the bins and Info-Bars must be approved by Etobicoke prior to installation.
4.OMG Media must comply with requests from Etobicoke to remove any bins or Info-Bars that have already been
installed.
5.All advertising shall be in accordance with the regulations and standards set by the Advertising Council of Canada, will
not include advertising of tobacco products and will be free of vulgarity or indecent suggestions in the opinion of
Etobicoke.
6.The agreement stipulates the prices that OMG Media will pay Etobicoke per bin and Info-Bar installed. For the first two
years of the agreement, OMG Media must pay Etobicoke $5.00 per month for each litter bin and Info-Bar installed. The
monthly price per unit escalates a dollar each year thereafter until year seven when it remains at $10.00 per unit per month
for the balance of the contract. Higher prices are stipulated in the agreement if the end faces of the litter bins are also used
for advertising.
To date, approximately one hundred of the OMG Media litter bins and thirty-five of the Info-Bars have been placed in
various locations in the Etobicoke Community Council area. OMG Media has worked cooperatively with staff on this
project and has been responsible and diligent in fulfilling the requirements of the agreement. There have been a few
instances where bins and Info-Bars were placed by OMG Media in locations that were not approved in advance by the City.
However, this was due to a procedural misunderstanding and OMG Media quickly removed the bins and Info-Bars in
question when requested to do so by the City. All revenue payments to the City have been paid by OMG Media when due.
As a result of the agreement with OMG Media, it is expected that a total of approximately four hundred litter bins and
seventy-five Info-Bars will be placed in the Etobicoke Community Council area by the end of 1999.
Conclusion:
To date, OMG Media has worked cooperatively with staff on the litter bin and Info-Bar project and has been responsible
and diligent in fulfilling the requirements of the agreement.
