Maintenance of Fence - 33 Gloucester Street (Downtown)
The Toronto Community Council recommends the adoption of the following report (February 26, 1999) from the
Manager, Right of Way Management, Transportation Services, District 1:
Purpose:
To report on a request to maintain a 1.2 m high wrought iron fence within the public right-of-way fronting 33 Gloucester
Street, which exceeds the maximum height of 1.0 m permitted under Chapter 313 of the former City of Toronto Municipal
Code. As this is a request for a variance from the by-law, it is scheduled as a deputation item.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendation:
That City Council approve the maintenance of the 1.2 m high wrought iron fence within the public right-of-way fronting 33
Gloucester Street, subject to the owner entering into an encroachment agreement with the City of Toronto, as prescribed
under Chapter 313 of the former City of Toronto Municipal Code.
Comments:
Mr. Manny Marcos, Marcos Developments Inc., 222 Brock Avenue, Toronto, Ontario M6K 2L9, on behalf of the owner,
Ms. Mabel Hedley, 33 Gloucester Street, Toronto, Ontario M4Y 1L8, submitted an application on December 4, 1998,
requesting permission to maintain a 1.2 m high wrought iron fence within the public right-of-way fronting 33 Gloucester
Street.
Staff have inspected the area in the immediate vicinity of this property. As there are similar fences in the area, it was
determined that the fence, as constructed, does not negatively impact the public right-of-way.
Details of the fence are retained on file with my Department.
Conclusions:
As the fence does not negatively impact on the public right-of-way, this installation should be permitted.
