To Amend By-law No. 89-1999, a by-law

"To acquire certain interests in land for or in connection with

the Sheppard Subway Project"

WHEREAS By-law 89-1999 was enacted by City Council at its meeting of March 2, 3 and 4, 1999 "To acquire certain interests in land for or in connection with the Sheppard Subway Project"; and

WHEREAS the said By-law 89-1999 contains a typographical error;

The Council of the City of Toronto HEREBY ENACTS as follows:

1.Section 2 of By-law No. 89-1999, a by-law "To acquire certain interests in land for or in connection with the Sheppard Subway Project" is amended by deleting, in the second last and last lines of the said section, the words "Part 1 on draft Plan of Survey No. 94-21-413-50-A, prepared by J.D. Barnes Limited" and inserting in lieu thereof "Part 2 on draft Plan of Survey No. 94-21-413-50-A prepared by J.D. Barnes Limited", such that Section 2 of By-law No. 89-1999 reads as follows:

2.A leasehold interest for a period of thirty months commencing on the date on which possession is obtained is hereby expropriated and taken for or in connection with the Sheppard Subway Project of the Rapid Transit Expansion Program pursuant to the provisions of subsection 191(1) of the Municipal Act, in the lands municipally known as 204 Sheppard Avenue West, described as Parcel 48-1, Section M389, being part of Lot 48, Plan M-389, in the City of Toronto (formerly the City of North York), and designated as Part 2 on draft Plan of Survey No. 94-21-413-50-A, prepared by J.D. Barnes Limited.
