Bill No. 294

BY-LAW NO.

To amend Section 408-8. of the Toronto Municipal Code,

a by-law providing for the designation of private roadways as fire routes,

a by-law of the former City of Toronto.

WHEREAS, pursuant to the City of Toronto Act, 1997, S.O. 1997, c. 2, every by-law or resolution of an old council that is in force immediately before January 1st, 1998 is deemed to be a by-law or resolution of the Council of the City of Toronto and remains in force, in respect of the part of the urban area to which it applied immediately before January 1st, 1998, until the Council repeals it or amends it to provide otherwise; and

WHEREAS Section 408-8. of the Municipal Code of the former City of Toronto (to be referred to in this By-law as the "Former Toronto Municipal Code") provides for the designation of private roadways as fire routes; and

WHEREAS Section 408-8. of the Former Toronto Municipal Code was in force in the former Toronto immediately before January 1st, 1998 and has not been repealed or amended to provide otherwise by the Council of the City of Toronto; and

WHEREAS the Council of the City of Toronto wishes to amend Section 408-8. of the Former Toronto Municipal Code,

The Council of the City of Toronto HEREBY ENACTS as follows:

1.Section 408-8. of the Former Toronto Municipal Code is amended by inserting after Subsection 408-8.B. the following new Subsection:

B.1The Solicitor will process by-laws designating fire routes on certification by the Fire Chief that the criteria set out in Subsection A. have been met.

2.Subsection 408-8.D. of the Former Toronto Municipal Code is amended by adding the following new clause:

(4)Despite Subsection 400-2.A., for the purposes of Subsection 408-8.D., "Committee" means Toronto Community Council.

3.Section 408-8. of the Former Toronto Municipal Code is amended by inserting after Subsection 408-8.D. the following new Subsection:

E.In Section 408-8. "Fire Chief" includes the duly authorized designate of the Fire Chief.

4.This amending By-law is retroactive to April 15th, 1999.
