BY-LAW NO.

To amend Chapter 400 of the Toronto Municipal Code,

the Traffic and Parking Code,

a by-law of the former City of Toronto,

respecting the designation of private roadways

at 436 Wellington Street West and 26-28 Marlborough as fire routes

WHEREAS, pursuant to the City of Toronto Act, 1997, S.O. 1997, c. 2, every by-law or resolution of an old council that is in force immediately before January 1st, 1998 is deemed to be a by-law or resolution of the Council of the City of Toronto and remains in force, in respect of the part of the urban area to which it applied immediately before January 1st, 1998, until the Council repeals it or amends it to provide otherwise; and

WHEREAS Section 408-8. of the Municipal Code of the former City of Toronto (to be referred to in this By-law as the "Former Toronto Municipal Code") provides for the designation of private roadways as fire routes; and

WHEREAS Section 408-8. of the Former Toronto Municipal Code was in force in the former Toronto immediately before January 1st, 1998 and has not been repealed or amended to provide otherwise by the Council of the City of Toronto; and

WHEREAS Section 408-8. of the Former Toronto Municipal Code, despite its amendment by the Council of the City of Toronto, continues to be force,

WHEREAS the requirements under Section 408-8. of the Former Toronto Municipal Code have been met by letters of certification both dated April 15th, 1999 from the Fire Chief to the City Solicitor respecting the designation of private roadways at 436 Wellington Street West and 26-28 Marlborough as fire routes; and

WHEREAS the conditions established under Section 408.8 have been satisfied for the amendment by the Council of the City of Toronto of Chapter 400 of the Former Toronto Municipal Code for the purpose of designating these private roadways as fire routes,

The Council of The City of Toronto HEREBY ENACTS as follows:

1.The Former Toronto Municipal Code is amended:

(a)by inserting in Schedule XXXIV (Route) of Section 400-87 the following:

(37)Within the lands municipally known as 436 Wellington Street West as shown on the plan attached as Appendix C-37 at the end of this Chapter.

(38)Within the lands municipally known as 26-28 Marlborough Avenue as shown on the plan attached as Appendix C-38 at the end of this Chapter.
