Implementation of Two-Sided

Overnight Permit Parking on

Donlands Avenue Between

Mortimer Avenue and Sammon Avenue

(City Council on April 13, 14 and 15, 1999, adopted this Clause, without amendment.)

The East York Community Council recommends adoption of the following report (March 8, 1999) from the Manager, Right of Way Management, Transportation Services, District 1:

Purpose:

To report on the introduction of overnight permit parking on both sides of Donlands Avenue, between Mortimer Avenue and Sammon Avenue.

Funding Sources, Financial Implications and Impact Statement:

Not applicable.

Recommendations:

It is recommended that:

(1) overnight permit parking be permitted on both sides of Donlands Avenue, between Mortimer Avenue and Sammon Avenue, on a street name basis, to operate during the hours of 11:00 p.m. to 5:00 a.m., 7 days a week;

(2) Schedule A of Overnight Parking Permit By-law No. 20-96, of the former Borough of East York, be amended to incorporate two-sided overnight permit parking on Donlands Avenue, between Mortimer Avenue and Sammon Avenue; and

(3) the appropriate City Officials be authorized and directed to take the necessary action including the introduction of the necessary Bill in Council to give effect thereto.

Background:

A request was received from Councillor Jane Pitfield on December 3, 1998, accompanied by a petition from the residents of Donlands Avenue, between Mortimer Avenue and Sammon Avenue, requesting the feasibility of overnight permit parking on both sides of the street.

Comments:

Donlands Avenue, between Mortimer Avenue and Sammon Avenue, operates two-way traffic, northbound and southbound with a pavement width of 13.41 metres. Parking on Donlands Avenue is presently regulated by alternate side permit parking, where parking rotates side-to-side, on a monthly basis, allowed by permit only, between the hours of 11:00 p.m. and 5:00 a.m. and for a maximum period of three hours at all other times.

This section of Donlands Avenue, between Mortimer Avenue and Sammon Avenue, is sufficiently wide enough to enable two-sided permit parking. Inspection by staff confirmed that this would increase the number of parking spaces on this block by 15 spaces without adversely affecting traffic operation or safety and at the same time providing much needed additional parking in the area.

Conclusions:

A petition was submitted by 21 residents of the 51 affected properties on Donlands Avenue, between Mortimer Avenue and Sammon Avenue.

Given that Donlands Avenue, between Mortimer Avenue and Sammon Avenue, is already authorized for permit parking on an alternate side basis, no poll is required to ascertain support for the implementation of overnight permit parking on both sides of the street.

The proposal will provide 15 additional parking spaces for residents of this portion of the street. It is, therefore, recommended that permit parking be introduced on both sides of Donlands Avenue, between Mortimer Avenue and Sammon Avenue.

Between O' Connor Drive and Plains Road

The East York Community Council recommends:

(1) the implementation of a "No Left Turn, 4:00 p.m. to 6:00 p.m., Monday to Friday, except public holidays" restriction for westbound traffic on O'Connor Drive at Cadorna Avenue; and

(2) the introduction of the necessary Bill in Council to give effect thereto.

The East York Community Council submits the following report (March 9, 1999) from the City Clerk:

Purpose:

To report the results of a traffic poll conducted on Cadorna Avenue between O'Connor Drive and Plains Road with respect to the implementation of a "No Left Turn, 4:00 p.m. to 6:00 p.m., Monday to Friday, except public holidays" restriction for westbound traffic on O'Connor Drive at Cadorna Avenue.

Funding Sources, Financial Implications and Impact Statement:

The proposed changes can be accommodated from within the existing Operating Budget.

Recommendation:

It is recommended that this report be received for information.

Council Reference/Background/History:

The East York Community Council at its meeting held on November 12, 1998, requested the City Clerk to poll the residents of Cadorna Avenue between O'Connor Drive and Plains Road, with respect to the implementation of a "No Left Turn, 4:00 p.m. to 6:00 p.m., Monday to Friday, except public holidays" restriction for westbound traffic on O'Connor Drive at Cadorna Avenue.

Comments and/or Discussion and/or Justification:

The results of the poll are as follows:

Public Meeting Held in Accordance

with the Planning Act with respect to

Zoning By-law Amendments

to Remove Regulations Governing

Fences on Decks and Platforms

The East York Community Council, based on the findings of fact and conclusions, recommends adoption of the following report (February 12, 1999) from the Director of Community Planning, East District.

The East York Community Council reports having held a statutory public meeting on March 30, 1999, in accordance with Section 34 of the Planning Act, and appropriate notice of this meeting was given in accordance with the Planning Act and the regulations thereunder.

The East York Community Council submits the following report (February 12, 1999) from the Director of Community Planning, East District:

Purpose:

On January 20, 1999, the Director of Municipal Standards reported to the East York Community Council regarding a conflict in law between the East York Zoning By-law Nos. 1916 and 6752 and the Fence By-law No. 81-89. The Community Council subsequently requested the Planning Division to prepare amendments the zoning by-laws to remove regulations governing fence and screen heights on decks. The purpose of this report is to address that issue.

This report is for consideration by the East York Community Council at the public meeting of March 30, 1999.

Recommendations:

It is recommended that City Council approve amendments to Zoning By-law No. 1916 and Zoning By-law No. 6752 to remove regulations governing fence and screen heights on decks and platforms.

Background:

During the course of investigating a complaint, by-law enforcement staff found that three by-laws regulate the height of fences or privacy screens on decks in East York.

By-law No. 81-89 is the fence by-law in East York. It was passed under the authority of the Municipal Act and regulates fences on private property. The by-law permits the construction of a fence on a deck, provided the fence is not more than 1.9 metres (6 feet 3 inches) in height above the deck surface, and provided it is not more than 2.4 metres (7 feet 10 inches) in height above grade. This by-law applies to all properties in the East York Community.

There are similar regulations in Zoning By-laws Nos. 1916 and 6752 that apply to properties in residential zones. The zoning by-laws establish the same height restrictions as the fence by-law.

The problem with regulating fences in this way is that a person wishing to construct a higher fence must obtain exemptions from the fence by-law and the applicable zoning by-law. This involves making applications under two separate processes. Under the Planning Act, a person can seek a minor variance from a zoning regulation by making an application to the Committee of Adjustment. Under the fence by-law, a person can apply to the Community Council for an exemption. In theory, a person may be successful in obtaining an exemption from one by-law, but not the other by-law.

Comments:

In the opinion of Planning staff, there is no reason to maintain duplicate regulations for deck fences. It is appropriate to remove the regulations regarding decks and platforms from the zoning by-laws, rather than from the fence by-law. There are similar regulations in the draft City-wide fence by-law. Staff anticipate that the by-law will be forwarded to Council for enactment in the second quarter of 1999.

Community Consultation:

Notice of this public meeting was given by publication in the Toronto Star.

Conclusions:

In the opinion of staff, it is appropriate to remove regulations governing deck fences from the zoning by-laws in order to eliminate duplication and conflicts with deck fence regulations in the fence by-law. Staff are recommending that Zoning By-laws Nos. 1916 and 6752 be amended to remove these regulations.

WHEREAS authority is given to Council by Section 34 of the Planning Act, R.S.O. 1990, c.P. 13, as amended, to pass this By-law; and whereas Council of the City of Toronto has provided adequate information to the public and has held at least one public meeting in accordance with the Planning Act;

The Council of the City of Toronto HEREBY ENACTS as follows:

1. Zoning By-law No. 6752 is hereby further amended by deleting subsection 5.6 h) in its entirety and replacing it with a new subsection 5.6 h) as follows:

"5.6 h) Any wall, partition, separator or screen, forming part of an unenclosed porch which is not supporting a roof or canopy, and which is attached to or forming part of the Building devoted to the principal use of the Lot on which it is situated, shall not exceed 1.9 metres in height above the surface of the porch and shall not exceed 2.4 metres in height above Grade."

870 Pape Avenue, Repeal of

Part Lot Control Exemption

Block 7, Plan 66M-2325

(City Council on April 13, 14 and 15, 1999, adopted this Clause, without amendment.)

The East York Community Council recommends adoption of the following report (March 5, 1999) from Loopstra, Nixon and McLeish, Barristers and Solicitors:

Purpose:

That City Council adopt the following report and enact the By-law as Appendix "1" hereto to repeal the part lot control exemption and restore part lot control to a portion of these lands.

Financial Implications:

The cost of preparing and registering this by-law will be paid by the owner.

Recommendations:

It is recommended that:

(1) City Council enact the attached By-law; and

(2) Loopstra, Nixon and McLeish, Solicitors for the East York Office, be instructed to register the said By-law on title to the lands, to which the By-law applies as required by section 50(7.5) of the Planning Act.

Background:

On July 29, 30 and 31, 1998 City Council adopted Clause No. 5 of Report No. 11 of the East York Community Council. The report indicated that immediately upon the conveyance of each lot, the City Solicitor for the East York Office be directed to bring forward a by-law to repeal the part lot control exemption.

Comments:

Since the time of that report, the owner has conveyed title to 12 lots. The original by-law passed by City Council on July 31, 1998 (By-law No. 485-1998) had the effect of lifting part lot control on Block 7 only. A second by-law was subsequently passed for the balance of the lands in order to permit the conveyance of title to each individual lot. Without part lot control, conveyances can occur without City Council approval. Therefore it is appropriate to restore part lot control now that these conveyances have occurred.

Conclusions:

It is appropriate for City Council to enact the By-law attached as Appendix "1" hereto with respect to the repeal of part lot control exemption.

Whereas, pursuant to the provisions of Section 50(7) of the Planning Act, R.S.O. 1990, the Council of a municipality may by by-law provide that Subsection 50(5) of the Act does not apply to certain lands within a plan of subdivision designated in the by-law;

And Whereas, pursuant to the provisions of Section 50(7.5) of the Planning Act, R.S.O. 1990, the Council of a municipality may amend such a by-law to delete part of the land described therein.

The Council of the City of Toronto Hereby Enacts as follows:

1. That By-law No. 485-1998, "A by-law pursuant to the provisions of Section 50(7) of the Planning Act, R.S.O. 1990, c. (February 12, 1999) from the City Clerk forwarding Clause No. 3 contained in Report No. 2 of The Strategic Policies and Priorities Committee, headed "Proposed 1999 Operating Budget Process and Schedule" which was adopted, as amended, by the Council of the City of Toronto at its meeting held on February 2, 3, and 4, 1999.

(d) Service Level Harmonization.

The East York Community Council reports having received the following communication and joint report:

(February 24, 1999) from the City Clerk forwarding the report (February 19, 1999) from the Chief Administrative Officer with respect to service level harmonization; and

(March 18, 1999) from the Chief Administrative Officer and Chief Financial Officer and Treasurer, addressed to The Budget Committee, providing a summary of the financial impact of the various service harmonization proposals.

(e) Introduction of Overnight Permit Parking on

Woodycrest Avenue Between Mortimer Avenue

and Westwood Avenue.

The East York Community Council reports having adopted the following report; and further, requested the Commissioner of Works and Emergency Services to submit a report to the next meeting of the Community Council, scheduled to be held on April 28, 1999, indicating which streets in East York will benefit from windrow clearing next winter:

(March 8, 1999) from the Manager, Right of Way Management Services, Transportation Services, District 1, reporting on the introduction of overnight permit parking on Woodycrest Avenue, between Mortimer Avenue and Westwood Avenue, on a street name basis, to operate during the hours of 11:00 p.m. to 5:00 a.m., 7 days a week; and recommending that:

(1) the City Clerk be directed to conduct a formal poll of the residents of Woodycrest Avenue, between Mortimer Avenue and Westwood Avenue, to determine support for the implementation of overnight permit parking;

(2) the City Clerk report the results of the poll to the East York Community Council; and

(3) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.

(f) Amendment to Parking Regulations on

Rumsey Road Between Broadway Avenue

and Glenvale Boulevard.

The East York Community Council reports having adopted Recommendation No. (1) embodied in the following report:

(March 8, 1999) from the Director, Transportation Services, District 1, advising that a request had been received by Councillor Pitfield in response to a petition received from residents on Rumsey Road, between Broadway Avenue and Glenvale Boulevard, to reduce long-term parking by persons attending the Institutions north of Glenvale Boulevard; further advising that the funds associated with the implementation of the proposed parking regulation amendments are contained in the Transportation Services Division's 1999 Current Budget Estimates; that the estimated cost of installing appropriate signs is $600.00; and recommending that:

(1) the City Clerk be directed to conduct a formal poll of the residents of Rumsey Road, between Broadway Avenue and Glenvale Boulevard, to determine support for the implementation of a one-hour maximum parking limit on both sides of Rumsey Road, between Broadway Avenue and Glenvale Boulevard, between 10:00 a.m. and 6:00 p.m., Monday to Friday and/or the implementation of a "No Parking Anytime" restriction on both sides of Rumsey Road between Broadway Avenue and Glenvale Boulevard between 8:00 a.m. and 10:00 a.m.; and

(2) that the appropriate City officials be requested to take whatever action is necessary to give effect thereto, including the introduction in Council of any Bills that are required.

(g) Preliminary Evaluation Report Official Plan

and Zoning By-law Amendment Applications

and Site Plan Approval by Richard Wolfe on

Behalf of 850901 Ontario Ltd. - 60 Overlea Boulevard.

The East York Community Council reports having adopted the following report subject to amending Recommendation No. (1) to provide that the Public Meeting be held on June 23, 1999, in the evening.

(March 5, 1999) from the Director of Community Planning, East District providing a preliminary report on a new application for Official Plan and Zoning By-law Amendments and concurrent Site Plan Approval for the property known municipally as 60 Overlea Boulevard; and recommending that:

(1) the East York Community Council convene a Public Meeting (under the Planning Act) to consider the Official Plan Amendment and rezoning application and that the Public Meeting be scheduled for a Community Council meeting for the second quarter of 1999; and

(2) the City Clerk be instructed to provide public notice by circulation.

Mr. Richard Wolfe, on behalf of 60 Overlea Boulevard, appeared before the East York Community Council in connection with the foregoing and submitted a photographic summary in support of their site plan revision.

(h) Pylon Sign at 25 Bermondsey Road.

The East York Community Council reports having referred the following communication to the Commissioner of Urban Planning and Development Services with a request that she submit a report thereon to the next meeting of the Community Council scheduled to be held on April 28, 1999:

(February 16, 1999) from Mr. D. Maniates, Architect, commenting on the size and location of an illuminated pylon sign at the above-noted address and requesting that the owner be permitted to relocate the sign.

(i) Council Legislative Process Review

Deputations at Committee Meetings.

The East York Community Council reports having received the following communication:

(February 12, 1999) from the City Clerk forwarding Clause No. 2 contained in Report No. 1 of The Special Committee to Review the Final Report of the Toronto Transition Team, headed "Council Legislative Process Review - Deputations at Committee Meetings", which was adopted, as amended, by the Council of the City of Toronto at its meeting on February 2, 3 and 4, 1999.

(j) Rusty Water Problem.

The East York Community Council reports having requested the Commissioner of Works and Emergency Services to submit a report to the next meeting of the Community Council scheduled to be held on April 28, 1999, providing a list of watermains to be cleaned and lined in East York in 1999.

(March 12, 1999) from the Director, Water and Wastewater Operations, Water and Waste Water Services Division, Districts 1 and 2, informing the East York Community Council of the options that are available to assist residents who have "rusty water" problems and to advise proposed actions for Sutherland Drive; advising that the estimated cost to clean and cement mortar line the section of watermain along Sutherland Drive from Parkhurst Boulevard to McRae Drive is $18,000.00. This cost is included in the approved 1999 Capital Budget under the Watermain Cleaning and Lining Program; and recommending that the report be received for information.

(k) Harmonization of Water and Water

Pollution Control Rates.

The East York Community Council reports having received the following report:

(March 22, 1999) from the Chief Financial Officer and Treasurer, addressed to the Budget Committee, presenting a review of the current practices and rate structure respecting the water and wastewater program, and recommending a strategy towards a harmonized rate structure across the new City.

(l) New Planning Applications Received.

The East York Community Council reports having received the following report:

(March 4, 1999) from the Director of Community Planning, East District, advising of new planning applications received and recommending that the report be received for information.

(m) Traffic Concerns on MacNaughton Road.

The East York Community Council reports having received the following report:

(March 16, 1999) from the Director, Transportation Services, District 1, reporting on the impact of a "No Right Turn" restriction for westbound traffic on Millwood Road at MacNaughton Road and recommending that the report be received for information.

(n) Residential Water Services

Connection Repair Program.

The East York Community Council reports having deferred consideration of this matter to its next meeting scheduled to be held on April 28, 1999.

(March 26, 1999) from the Director of Quality Control and System Planning, Water and Wastewater Services; forwarding, as directed by the Works and Utilities Committee, a report, dated October 23, 1998, from the General Manager, Water and Wastewater Services, addressed to the Works and Utilities Committee, seeking approval for a harmonized Residential Water Service Connection Repair Program; and requesting the Community Council to report back to the Works and Utilities Committee for its meeting scheduled to be held on April 21, 1999; and

(November 20, 1999) from the Commissioner of Works and Emergency Services, responding to requests by the Works and Utilities Committee in considering the report (October 23, 1998) from the General Manager, Water and Wastewater Services, respecting a Residential Water Service Connection Repair Program.

(o) Parking Regulations on Airdrie Road.

The East York Community reports having referred the following report and communication back to the Director, Transportation Services, District 1, with the request that he investigate the matter further and submit a report to the East York Community Council for its meeting scheduled to be held on April 28, 1999, on the feasibility of designating the three proposed parking spaces as permit parking allocated to specified addresses; and, further, adding two more parking spaces in a similar manner:

(March 11, 1999) from the Director, Transportation Services, District 1, responding to a request from the East York Community Council regarding an amendment to parking regulations on Airdrie Road to accommodate local residents during the summer months (May - September) when starlings return and roost in trees on Airdrie Road; advising that the funds associated with the implementation of the proposed parking regulation amendments in the estimated amount of $600.00 can be accommodated within the 1999 Transportation Services Division Operating Budget request; and recommending that:

(1) a 12 hour parking restriction be implemented on the north side of Airdrie Road, from a point 15 metres north of Heather Road to a point 19 metres further north thereof, from May 1st to September 31st;

(2) parking be prohibited on the north side of Airdrie Road from a point 15 metres north of Heather Road to a point 19 metres further north thereof from October 1st to April 30th;

(3) parking be prohibited on the south side of Airdrie Road, from a point 15 metres north of Heather Road to a point 19 metres further north thereof, from May 1st to September 31st; and

(4) the appropriate City Officials be requested to take whatever action is necessary to give effect thereto, including the introduction in Council of any Bills that are required;

(March 24, 1999) from Mr. Richard J. Parton, East York, providing comments with respect to the proposed parking regulations;

(March 25, 1999) from Mr. Ralph Colin, East York, in opposition to the proposed parking regulations; and

(March 28, 1999) from Ms. Ann Yeoman, East York, providing comments with respect to the proposed parking regulations.
