Subject: F.G. Gardiner Expressway East Dismantling Project
Request for Authority to Acquire Property
Ward 25 - Don River
Purpose:
To obtain authority to negotiate for the acquisition of additional property required for the F.G. Gardiner Expressway East
Dismantling Project and to initiate the expropriation process for such lands.
Funding Sources, Financial Implications and Impact Statement:
Funds for this project are available in F.G. Gardiner Expressway East Dismantling Project C-TR-026-Q00008-6106.
Recommendations:
It is recommended that:
(1) staff of the Corporate Services Department be authorized to negotiate with the affected owner(s) for the acquisition of
the necessary lands or interests in land required for the F.G. Gardiner Expressway East Dismantling Project;
(2) authority be granted to initiate the expropriation process for the property interests detailed herein;
(3) authority be granted to serve and publish Notices of Applications for Approval to Expropriate said property interests, to
forward to the Chief Inquiry Officer any requests for hearings that are received and to report the Inquiry Officer's
recommendations to Council for its consideration; and
(4) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.
Background:
By adoption of Clause No. 34 of Report No. 7 of the Corporate Services Committee on June 3, 1998, Council authorized
the Commissioner of Corporate Services to negotiate with affected owners for the acquisition of the necessary land or
interests in land required for the F.G. Gardiner Expressway East Dismantling Project and further authority was granted to
make application for approval to expropriate and to serve and publish notice of such application pursuant to the
Expropriations Act. The lands required were identified on sketches attached thereto.
Comments:
It has recently come to light that there is an additional easement required over the lands identified on the attached sketch
No. EAS-496 to accommodate the relocation of a sewer necessitated by this Project. The required easement will include
provision for surface right-of-entry to maintain the sewer in perpetuity.
In addition, I am advised that during detailed design, it was ascertained that a larger parcel of land than that shown as Part 1
on Sketch Z-200-09 is required having an area of 2,265 sq.m. rather than 678 sq.m. The amended sketch Z-200-09 showing
the enlarged parcel as Part 1 thereon is attached hereto.
Conclusion:
In order to accommodate the F.G. Gardiner Expressway East Project construction schedule, authority to acquire the
properties identified in this report by negotiation or expropriation is required at this time. The Commissioner of Works and
Emergency Services concurs with the recommendations contained herein.
