Subject: Appeal of Committee of Adjustment Decisions

Purpose:

To advise Etobicoke Community Council of Committee of Adjustment Decisions which have been appealed to the Ontario Municipal Board and to recommend whether legal and staff representation is warranted.

Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendations

It is recommended that staff representation not be provided for the appeal regarding 5 Rathlyn Court.

Background:

An appeal of a Committee of Adjustment decision in the Etobicoke Community Council area relating to an application at 5 Rathlyn Court has been received from the Etobicoke Committee of Adjustment.

Comments:

The application and appeal is summarized as follows:

1) Address: 5 Rathlyn Court

Ward: Rexdale-Thistletown

Application No.: A-317/99ET

Applicant: Jaswinder, Parajit, Manjinder and A. Dhandal

Appellant: Jaswinder, Parajit, Manjinder and A. Dhandal

Date of Appeal: December 29, 1999

Hearing Date: To be determined by the OMB

Zoning: Third Density Residential (R3)

Application: This pie shaped property has a frontage of 5.79 m (19 ft). A one-storey single family semi-detached dwelling and detached two-car garage currently occupy the property. The applicant is proposing to legalize and maintain a basement walkout along the north side of the dwelling and a two-bedroom basement apartment. The applicants requested the following variances:

a) A semi-detached dwelling with a basement apartment unit is not listed as a permitted use on lands zoned R3; and

b) All driveways shall lead to a parking space, as required, whereas the basement walkout has eliminated access to the detached garage in the rear yard. Parking for the site will be on the existing driveway.

Decision of Committee of Adjustment: Refused

Comments: Staff have not identified any significant planning issues and do not recommend Planning or Legal Staff representation at the Ontario Municipal Board.

As background information, the City has made a commitment to allow second suites City wide in singles and semi-detached houses. The Ontario Municipal Board hearing regarding the appeal of that decision will commence on February 14, 2000 and is scheduled for five weeks.
