February 24, 2000
To: Etobicoke Community Council
From: City Solicitor
Subject: Ontario Municipal Board hearing dates in respect of the Outlook application to redevelop 5055 Dundas Street
West (the former Michael Power High School site)
Ward 3 (Kingsway-Humber)
Purpose:
To report upon hearing dates set by the Ontario Municipal Board in respect of Outlook's application to redevelop 5055
Dundas Street West.
Finance Implications and Impact Statement:
The adoption of this report has no financial implications or impact for the City.
Recommendations:
It is recommended that:
(1) this report be received for information.
Background:
At its meeting held on February 1, 2 and 3, 2000, Toronto City Council adopted the recommendations of the Etobicoke
Community Council as contained in Cl. 13 of Etobicoke Community Council Report No. 1 and thereby refused the
application by Outlook Investment and Developments Limited ("Outlook") to amend the Official Plan and Zoning By-law
to permit a development containing 1275 dwelling units on the former Michael Power High School site at 5055 Dundas
Street West. As the matter had already been appealed by Outlook to the Ontario Municipal Board (the "OMB") and as a
prehearing date was scheduled for February 11, 2000, Council authorised the City Solicitor to advise the OMB,
(1) it was the position of City Council that it would be premature for the OMB to consider the Outlook application in
advance of the completion and consideration by City Council of the Secondary Plan Review and the review of the
Franciscan Father's Application, and
(2) that City Council therefore requested the OMB to set a date for a further prehearing conference to report upon the
progress of the Secondary Plan Review and the review of the Franciscan Father's Application.
Comments:
At the February 11, 2000 prehearing the OMB,
(1) set April 10, 2000 as a date for a further prehearing conference, and
(2) set a hearing date for Outlook's appeal, commencing on May 15 and continuing to June 2, 2000 (exclusive of May 18,
19, and 22, 2000).
As Urban Planning and Development Services do not support Council's opposition to Outlook's application, it will be
necessary for the City Solicitor to retain outside consultants to present evidence before the OMB in opposition to the
application.
Conclusions:
It is appropriate to receive this matter for information.
