Subject: Request for Direction

ON MINOR VARIANCE APPEALS

Purpose:

The purpose of this report is to seek direction from Council regarding appeals of the Committee of Adjustment decisions described below. This report is for the consideration of the East York Community Council at their meeting of February 15, 2000.

Financial Implications and Impact Statement:

There are no financial implications for the City of Toronto in this report.

Recommendations:

It is recommended that this report be received for information.

Comments:

1. Variance Application A99EY130

Darryl Lane

3 King Edward Avenue

The applicant is proposing to construct a one-storey addition and basement extension at the front of the existing dwelling to create a basement apartment. On November 10, 1999, the Committee of Adjustment approved variances to the front and side yard setback requirements, but refused to grant an exemption to the parking requirement for the proposed basement apartment. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

2. Variance Application A99EY138

Francesco Labile

7 Parkview Hill Crescent

The applicant is proposing to demolish the existing dwelling on the property, and construct a new two-storey detached dwelling. He applied for a variance to the maximum building height restriction. On December 7, 1999, the Committee of Adjustment refused the application, and the applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

3. Variance Application A99EY139

Paul and Joanne Porter

35 Epsom Avenue

The applicant is proposing to construct a second storey addition to the existing one-storey dwelling, and requested a variance to the maximum building height restriction. On December 7, 1999, the Committee of Adjustment approved the application, and a neighbour appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.
