Florida Restaurant Boulevard Café/Patio
Extension of the Hours that Alcoholic Beverages can be served on the Patio
Purpose:
To report on the extension of the hours that alcoholic beverages can be served on the patio.
Financial Implications and Impact Statement:
Nil.
Recommendations:
The East York Community Council may recommend that:
(1) City Council deny the applicant's request for an extension of the hours that alcoholic beverages may be served on the
boulevard café/patio on the Westwood Avenue flank of 940 Pape Avenue, from 10:30 p.m. to 2:00 a.m.
OR
(2) (a) City Council approve the applicant's request for an extension of the hours
that alcoholic beverages may be served on the boulevard café/patio on the Westwood Avenue flank of 940 Pape Avenue,
from 10:30 p.m. to 2:00 a.m.;
(b) that approval be granted subject to the applicant complying with the criteria set out in By-law No. 16-97, of the former
Borough of East York;
(c) that the applicant enter into an agreement with the City of Toronto which reflects the change in hours; and
(d) that staff be requested to report back to the East York Community Council on the operation of the café under the
extended hours after the 2000 café season.
Background:
The Florida Restaurant currently occupies a portion of the boulevard for the purpose of a boulevard café/patio under an
agreement enacted January 19, 1984. Section 8 of the agreement, requires the owners to cease service of alcoholic
beverages on the patio at 10:30 p.m.
The present owner of the Florida Restaurant (Mr. Costa Baklais), who has run the restaurant for the past six years, has
made a request to have this restriction extended to midnight or 2:00 a.m.
Comments:
Occupation of the boulevard for the purpose of operating a boulevard café is governed by the criteria set out in the former
Borough of East York By-law 16-97. One of the provisions of this By-law, Section 7, subsection (j) indicates, "the
frequency, length and duration of the hours of use of the boulevard shall be subject to the approval of the Borough."
Our records indicate that we have no recent complaints pertaining to noise or the business operation. A representative of
Toronto Police Services, 54 Division has advised that one complaint was received in 1999. The complaint was in
connection with the service of alcohol around 11:50 p.m. The owner was cautioned and no additional complaint was
received.
During the review of the applicant's application and preparation of this report, staff received a petition signed by 108
residents in support of the applicants' request for a 2 a.m. closing of the patio.
The Clerk's Office has notified the owners and occupants within a 100 meter radius of The Florida Restaurant advising
them of Mr. Baklais' request.
Conclusion:
On hearing the deputations, the East York Community Council must decide whether or not to recommend that City
Council grant the extension of the hours for the service of alcoholic beverages, for the boulevard patio on the Westwood
Avenue flank of 940 Pape Avenue.
