Subject Report - Noise By-Law Exemption (By-Law # 31317) - 4950 Yonge Street

Madison Centre Renovations. North York Centre

Purpose:

To report on an application (November 15, 1999) received from Mr. Jerry Crawford, Project Estimator, BFC Buildings, requesting an exemption to North York Noise By-Law #31317, as amended, to permit construction to continue between the hours of 7:00 p.m. and 10:00 p.m. at night from January 20, 2000 to June 16, 2000, Mondays to Saturdays only.

Financial Implications and Impact Statement:

There are no financial implications for the City with regard to this matter. Recommendations:

It is recommended that this application be approved subject to:

1. The posting of the name of a responsible individual on site along with a telephone number that will be answered during the hours of construction in the event of a noise complaint. This information is to be provided to the District Manager, Municipal Licensing and Standards at 395-7015.

2. Screening of an area at the north end of the building to house two disposal bins for the removal of debris from the proposed construction to isolate the residential portion of the building as much as possible from the noise associated with the dumping of debris into these bins.

Background:

The property which is the subject of this application is located on the west side of Yonge Street north of Elmhurst Avenue. It is the intention of the owner, Beutel Goodman Real Estate Group, to renovate approximately 85,000 square feet of interior ground and concourse floor levels which has 20 floors of occupied office space above and shares a common ground floor slab with an adjoining residential multi-storey structure attached.

Comments:

The proposed construction will result in the extensive renovation of the concourse and ground floor of the premises. North York By-Law 31317, as amended, does not permit construction noise between the hours of 7:00 p.m. and 7.00 a.m. the following morning, Sundays and Statutory Holidays. The extending of the time until 10:00 p.m. on Mondays through Saturdays would reduce the period of disturbance to the residents of the multi-residential portion of the property and would contain the time frame to the winter and spring months.

Conclusions:

Permitting this exemption would reduce the overall impact of the construction by shortening the length of time of the disturbance to the residential occupancies.
