Purpose:
Evaluate and make recommendations regarding a request by Franco Romano of Action Planning Consultants, for a
variance from the Sign By-Law to permit wall and ground signage for a restaurant in a residential zone. Action Planning
Consultants have been retained by the TDL Group Limited (Tim Hortons) and act as agent for Niot Investments Holdings
Limited.
The property is located at the Northwest corner of Lawrence Ave. East and Don Mills Rd. Refer to attachments for details.
Recommendations:
It is recommended that:
(1) The request for a minor variance from the Sign By-law be approved.
Financial Implications & Impact Statement:
There are no financial implications.
Council Reference/Background/History:
The building at 980 Lawrence Ave. East is located in a Residential (RM6(49)) which does not permit the proposed retail
signage. The proposed fascia sign is 58sq.ft. and is located on the east wall of the building facing Don Mills Rd. There is a
proposed 5sq.ft. and 4ft. in height identification ground sign along the Don Mills frontage. There are also a proposed
22sq.ft. 7.5ft. in height Menu Board ground sign and a proposed 2sq.ft. directional sign along the Lawrence frontage.
The proposed signage would be permitted for a restaurant in a commercial or industrial zone. The Committee of
Adjustment, under decision # UDCA-98-363, approved the proposed restaurant use at this location. A building permit
application for the proposed restaurant has been submitted and is presently under review (B99-108107). The sign permit
will be withheld until the building permit is issued.
The Ward Councillors have been notified of this request and have been provided with a copy of this report and attached
plans.
Conclusions:
It is my opinion that the proposed signage is appropriate and would not have a negative impact on the surrounding area. It
is recommended that the minor variance to the Sign By-law be approved, in light of the C. of A. decision to permit this use
in a residential zone.
