Subject: Driveway Entrance: 172 Rustic Road

(North York Humber)

Purpose:

The property owner has requested a semi-circular driveway entrance (two driveway entrances) on a 50 feet lot to accommodate his disability.

Financial Implications and Impact Statement:

The applicant would be required to pay for a curb cut application and to complete the restoration of the driveway. The cost for the curb cut and application fee can be deducted from the Municipal Services Damage Guarantee.

Recommendation:

It is recommended that the request for a second driveway not be approved.

Background:

On June 2, 1993 the Works Committee of the former City of North York, by Resolution No. 93-21, adopted Clause 3, Report No. 9, which states that "no more that one driveway shall be permitted to serve residential properties having less that 18.3 metres (60 feet) frontage." In addition, there is a requirement that driveways should commence at a 1 metre distance from the side yard to ensure that vehicles can properly manoeuvre in and out of the driveway. Finally, the increase in hard surface would have to be reviewed for compliance with the Hard Surface By-law.

Comments:

Approval of a circular driveway in this instance would require the Planning Department's approval with respect to the increased hard surface coverage. There is further concern that the circular driveway commencing with the recommended one metre side yard property setback could pose some difficulty in actually negotiating the turn with a mid-size vehicle.

Conclusion:

The proposed circular driveway does not meet the appropriate requirements and as such cannot be supported.
