Subject: Concrete Walkway and Curb Cut Installation: 540 Rustic Road

(North York Humber)

Purpose:

The property owner has requested the approval of a walkway with a curb cut on his corner lot, off Blandorman Road, to accommodate his disabled son

Financial Implications and Impact Statement:

The applicant would be required to pay for an encroachment agreement, a curb cut and to install the walkway. The cost for the curb cut and application fee can be deducted from the Municipal Services Damage Guarantee. The cost for the encroachment agreement would be required at the time the documents are to be executed.

Recommendation:

It is recommended that the resident enter into an encroachment agreement, to be registered on title to permit the walkway and curb cut. This would ensure reinstatement of the curb if the home were sold in the future.

Background:

The resident has requested the walkway and curb cut for his disabled son to gain access to a Wheel Trans vehicle. Apparently Wheel Trans will not pick-up from the home's driveway.

Conclusions:

The applicant presented extenuating circumstances, (stairs, etc.) which currently impedes the Wheel Trans pick-up of his some from locations on the property, other than a side door. There isn't, however, access from this door to the roadway. Given this situation, it would be appropriate to accommodate this request, ensuring that it will only be in place until it is no longer needed.

The property owner would require written approval from the utility companies (Gas, Bell, Hydro and Cable) for the walkway installation. Upon receipt of the letters of approval from the utility companies, the information will be forwarded to our Legal Department for them to process the encroachment agreement. The present cost to process the encroachment agreement is $400.00
