UDZ-98-09 - Zoning Amendment Application

Ward 10 - North York Centre
Purpose:
To make a decision on an application to amend the zoning by-law for lands located at 85 Steeles Avenue East to permit an
accounting business as a home occupation within an existing one-family detached dwelling.
Financial Implications and Impact Statement:
All of the costs associated with the processing of this application are included within the 2000 Operating Budget.
Recommendations:
It is recommended that:
(1) Council make a decision on the application.
Background:
In its report dated November 18, 1998, (Schedule 3) Staff recommended that this application be approved subject to the use
being a business office only and the maximum gross floor area of the business office be 13mē.
The application was considered by the North York Community Council on December 9, 1998 and January 20, 1999 at
which time Coucil referred the matter back to the Director, Community Planning, North District. On February 2, 3 and 4,
1999 Council adopted the deferral without amendment. Attached are copies of the Extracts of North York Community
Council and the Council of the City of Toronto (Schedules 1 and 2).
On October 27, 1999, the applicant filed an appeal with the Ontario Muncipal Board pursuant to Section 34 (11) of the
Planning Act. The section states that where council refuses or neglects to make a decision within 90 days after the receipt
of the application, the applicant may appeal to the Muncipal Board. A hearing date for the application has been set for
March 6, 2000.
