Subject:Variance for Ground Sign

3280 Dufferin Street

(Ward 8 - North-York Spadina)

Purpose:

Evaluate and make a recommendation regarding a request for a variance from the sign by-law by Mrs. Ingrid Brooks, to permit the erection of an illuminated third party 10 foot by 20 foot roof sign, within 390 feet of another roof sign where the by-law requires 750 feet.

Financial Implications and Impact Statement:

There are no financial implications associated with this report.

Recommendations:

It is recommended that:

(1)The request for a minor variance from the sign by-law refused.

Background and Comments:

The existing site is currently zoned MC (H) and there is an existing one storey building on the site. The applicant proposes to install an illuminated third party roof sign on the building. The proposed sign would face north and south along Dufferin Street on the West Side.

Under the regulations in Section 5.3.1.1 of the sign by-law, the required separation is 750 feet between any proposed roof sign and any existing roof signs on the same side of the street.

The proposed roof sign would be located approximately 390 feet south of the existing roof sign, which is located on the building on the Northwest corner of Dufferin street and Bentworth Avenue. The existing area has considerable signage in various forms; including existing roof signs, wall signs and ground signs, particularly along Dufferin Street. In addition there is an existing roof sign on the building at 16 Orfus Road which would be within 135 feet of the proposed sign if approved, the existence of this sign must also be considered when evaluating the merits of this variance request.

The area is highly commercialised and the granting of this type of variance may lead to similar request in this area.

 Conclusions:

It is my opinion that:

  • the proposed sign would have a negative impact on the surrounding area;
  • the proposed signage, is not in keeping with the provision of the sign by-law;
  • the proposed, variance is not minor in nature;
  • the approval of this variance may lead to further request for roof signage, which do not comply with the provisions of the sign by-law.
