 STAFF REPORT

February 15, 2000

To: Standing Committee/Noth Community Council

From: Edward Tipping, P. Eng Director and Deputy Chief Building Official

Subject:Variance for Proposed Roof Sign

4140 Bathurst Street

(Ward 8 - North-York Spadina)

Purpose:

Evaluate and make a recommendations regarding a request for a variance from the sign by-law by Peter Mezei, to permit the erection of an illuminated 10 foot by 20 foot billboard sign on the roof of an existing 3 story building.

Financial Implications and Impact Statement:

There are no financial implications associated with this report.

Recommendations:

It is recommended that:

(1)The request for a minor variance from the sign by-law be refused.

Background and Comments:

Community Council previously considered a variance request for this property on December 9, 1999, and at that time the request for a variance was refused. The proposal has not been changed since Community Council last considered it.

The building on which the sign is proposed is located in a residential zone (RM4) (see attached zoning map). The building fronts onto Bathurst Street and the proposed sign would face north and south along Bathurst Street. The subject building is not only located in a residential zone it also abuts single family dwellings (R4) on York Downs Drive, and the area surrounding the proposed sign on the west side of Bathurst Street is primarily residential.

Section 5.1 of the sign by-law does not permit the erection of roof signs in a residential zone. Considering this building is clearly in a residential zone and is in very close proximity to residential areas, the intent of the sign by-law to protect residential areas from signage would be compromised. In addition the height of the proposed sign approximately 52 feet above the adjacent grade would make it clearly visible for a significant distance into the surrounding residential streets. The Ward Councillors have been notified of this request and have been provided with a copy of this report.

 Conclusions:

It is my opinion that:

  • the proposed sign would have a negative impact on the surrounding residential area;
  • the proposed sign does not meet the intent of the sign by-law to protect residential areas from signage;
  • the proposed variance is not minor in nature and should not be granted.
