Purpose:

Appeals of the Official Plan Amendment application UDOP-99-38 have been filed by A. Milliken Heisey, solicitor for the applicant 584952 Ontario Limited.

Recommendations:

It is recommended that:

(1)Staff be directed to schedule a Community Consultation Meeting for March 28th, 2000;

(2)Staff be authorized to schedule a Public Meeting under the Planning Act to consider this application;

(3)Notices for Community Consultation Meeting and the Public Meeting under the Planning Act, be given in accordance with the Regulations under the Planning Act; and

(4)Staff be authorized to continue processing the application.

Background:

A Preliminary Report on this application (UDOP-99-38) for 1100 Sheppard Avenue West was approved by Community Council on February 15, 2000. At that meeting, Council also adopted motion stating that the applicant be advised that:

(1)the density increase from 1.1 to 4.5 is inappropriate and that the applicant should consider a base density consistent with development of a sub-centre in the Official Plan of the former City of North York, with modest bonusing to achieve community objectives;

(2)the introduction of a residential component into this isolated industrial sector can only be achieved if community amenities are provided on site; and

(3)the built form and nature of the development must take into account the community planning and consultation process that has been ongoing with respect to the 75 acres of City-owned land at the same intersection.

 Since the applicant has appealed his application to the Ontario Municipal Board, a Council decision is necessary for staff to prepare for the hearing. Thus, processing of the application should continue and a Final Report prepared.
