COMMITTEE OF ADJUSTMENT

Advising that the Parkview Hills Community Association passed a motion on November 8, 1999 "that the City's Ward 1 (East York) retain its own independent Committee of Adjustment or, alternatively, that Ward 1 be included as part of the City of Toronto's Committee of Adjustment rather than with that of (the former) Scarborough".

11. EXEMPTING NON-PROFIT HOUSING FROM PLANNING

APPLICATION FEES, BUILDING PERMIT FEES AND PARKLAND DEDICATION PAYMENT REQUIREMENTS

To waive the building permit fees and the payment in lieu of providing parkland for a 24 unit non-profit housing development at 647 - 657 Lawrence Avenue West (Site Plan Application UDSP-99-117) and exempt all non-profit housing from planning application fees, building permit fees and parkland dedication payment requirements, and recommending that:

(1) Council exempt a 24 unit non-profit housing development at 647-657 Lawrence Avenue West from the building fees payable under By-law No. 163-1998 and the parkland dedication requirements under By-law No. 30152 of the former City of North York;

(2) Council adopt a policy to waive all planning application fees, building permit fees and parkland dedication payment requirements for non-profit housing projects. The same definition of "non-profit housing" as was used in the development charges by-law (By-law No. 476-1999) should be used for the purposes of the waiver of these fees and payments; and

(3) Council direct City officials to not collect planning application fees, building permit fees and parkland dedication payment requirements for non-profit housing projects and authorize City officials to undertake any necessary action to give effect to the foregoing.

12. TORONTO LICENSING TRIBUNAL - SEMI ANNUAL REPORT, JANUARY-JUNE 1999

Reporting that the Licensing Sub-Committee recommends the adoption of the following recommendations contained in the report (August 19, 1999) from the Chair, Toronto Licensing Tribunal, titled "Toronto Licensing Tribunal - Semi Annual Report, January - June 1999":

(1) City Council amend Section 11(1) of By-law 20-85 to read as follows:

11(1) an applicant for a licence, or for the renewal of a licence is, subject to the provisions of this By-law, entitled to be issued the licence or renewal, except where,

(a) the conduct of the applicant affords reasonable grounds for belief that he has not carried on or will not carry on his trade, calling, business or occupation in accordance with law and with integrity and honesty; or

(b) there are reasonable grounds for belief that the carrying on of the trade, calling, business or occupation by the applicant has resulted or will result in a breach of this By-law or any other law; or

(c) the applicant is a corporation and its conduct or the conduct of its officers, directors, employees or agents affords reasonable grounds for belief that its trade, calling, business or occupation has not been or will not be carried on in accordance with law and with integrity and honesty; or

(d) there are reasonable grounds for belief that the premises, accommodation, equipment or facilities in respect of which the licence is required have not complied or will not comply with the provisions of this By-law or any other law; or

(e) the conduct of the applicant or other circumstances afford reasonable grounds for belief that the carrying on by the applicant of the business in respect of which the licence is sought infringed or would infringe the rights, or endanger the health or safety of other members of the public; and

(2) City Council direct the City Solicitor to amend By-law 20-85 to authorize the Tribunal to suspend penalty for a specified period of time, to be determined by the Tribunal.

Responding to City Council's direction that the Toronto Licensing Tribunal report at least semi-annually to the Emergency and Protective Services Committee (after June 1, 1999, the Planning and Transportation Committee), reporting on its activities since the restructuring of the Commission, outlining the Tribunal's purpose, composition, case statistics and recommendations, and submitting the recommendations noted above.

13. A PROGRAM TO GENERATE A HOUSING STOCK FOR SOCIAL AND SUPPORTIVE HOUSING PURPOSES: PROPOSAL REVIEW

To review a proposal for a "Social Housing Bonus" program to generate a housing stock for social and supportive housing purposes, and recommending that:

(1) City Council reaffirm its direction to the Commissioner, Urban Development Services that policies on urban intensification and the inclusion of affordable housing in new residential developments be considered a high priority in the preparation of a housing implementation plan as part of the Official Plan process;

(2) this report be forwarded to the Community Services Committee for information; and

(3) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.
