Purpose:
This report seeks direction from Council as to the City Solicitor's role at a pending Ontario Municipal Board hearing, as
further detailed below.
Financial Implications and Impact Statement:
None at this time.
Recommendations:
It is recommended that
City Council direct the City Solicitor not to attend the Ontario Municipal Board hearing with respect to minor variance
application No. SC-A19990316.
Comments:
The Committee of Adjustment on December 15, 1999, refused a minor variance to permit a dwelling to remain as
constructed having a maximum height of 10.86 metres, whereas the Zoning By-law as varied, restricts the building height
to 9.93 metres.
The decision was appealed to the Ontario Municipal Board by the owner. A hearing date on this matter has not been
scheduled at this time by the Board. The appeal does not raise issues of significance to the Corporation to warrant
expenditure of the City's limited resources on the Board hearing.
Conclusions:
The City Solicitor should be directed not to attend any Ontario Municipal Board Hearing with respect to Minor Variance
Application No. SC-A19990316.
